<br />1 4. Lane Air Pollution Authority - The City Manager explained the present arrangement under
<br />which the A~r Quality Control office is operated co-operatively with Springfield and
<br />Lane County. He said legislation enacted by the 1967 Legislature is worded in such a
<br />way as to prohibit Lane County's participation. beginning January 1, 1968. He recom-
<br />mended creation o~ ,a regional authority under the new legislation whereby Eugene,
<br />Springfield, and Lane County could continue the present air quality control function
<br />through a governing body comprised of one representative from each of the three agencies.
<br />.The authority under State law is given no taxing authority and must depend upon budget-
<br />ing by the participating agencies. . Funds have been budgeted under the present arrange-
<br />ment and would be used under the new authority on a contractual basis with each of the
<br />agencies until July 1, 1968. The Manager stated also that State law provides for 50%
<br />matching funds under a regional authority, whereas individual cities would receive only 30%. I ~

<br />Dr. Purdy moved seconded by Mr. Andersontq enter into agreement with Lane County and the city of
<br />Springfield to create a regional air' pollution authority. Motion carried. '

<br />2 5. Close Willamette, lath to 11th - A letter from BilL Watson, chairman of Students for
<br />Democratic Society, requested closure of one .lane of Willamette Street between lath and
<br />11th from 3:00 to 5:00 p.m. on Monday, December 4, 1967, at which time they plan a pro- I
<br />test demo~stration, at the Select~ve Service Office at 1074 Willamette. The Police De- I. .
<br />partment.recommended, because of traffic conditions, the demonstration be held from
<br />2:00 to 3:30 p:m., December 4; with the area cleared by 4:00 p.m., or that a parade per- I ~
<br />mit be issued for"a march down Willamette to the Park blocks prior to 4:00 p.m. Dis-
<br />cussion followed between the Police Chief, Mr. Watson, the City Manager, and Council -
<br />members with regard to alternatives, and Councilman Anders9n moved, seconded by Mr.Lassen,
<br />that the request be denied because of the traffic volume and number of people in the
<br />downtown 'area at this time of year. Motion carried, Mrs. Lauris voting no.

<br />3 6. Tent'P~rmit, Kendall Fbrd, 13th and Olive - The permit previously granted allbwing a
<br />t~nt for Kendall Foid show room at 13th and Olive expires December 31,1967. The
<br />Ford people requested extension'of the permit for 'the duration of their lease'- about
<br />one year.

<br />Dr. Purdy moved seconded by Mr. Anderson to extend the permit to July 1, 1968. Motion carried. I

<br />4 -Abatement, 955 East 43rd (See Page 522-2) - The City Manager explained Mr. Silas Messer,
<br />designer enga~ed by Elmer Sahlstrom, has indicated the building in question can be broughi
<br />to Code according to requirements listed in the detailed report from the Building Depart-
<br />ment with the exception of the upstairs ceiling height. A variance would have to be
<br />granted by the Building Board of Appeals for a substandard ceiling height. He recommended
<br />th~ ~batement proceedings be rescinded if a building permit can be issued on the plans and
<br />specifications to be submitted by Mr. Messer. Both'Mr: Sahlstrom'and Mr. Messer were present. I

<br />Mr. Henry Baitis said the legality of the subdivision has not been established, a street
<br />cannot be put through because a necessary signature is missing from the deed~ and the City ~
<br />did not comply with subdivision ordinances or house moving regulations.

<br />Mary jo Schmaedick,947 Hiwan Court, asked the Council to delay revocation of the abate-
<br />ment proceedings so it can be explained why the property has remained in its present con-
<br />dition since February 1967, and to determine how long it will remain as it is. The City
<br />Attorney ,stated. the subdivision is not illegal unless the Planning Commission revokes the ~
<br />minor subdivision or the Court declares it illegal, and that abatement proceedings.must be
<br />based entirely upon the hazardous conditions of a building, not its incompatibility with
<br />the surrounding area. He said the Court has made no decision with regard to the request
<br />for .Writ of Review filed by Mr.: Sahlstrom.:

<br />Dr. Purdy moved seconded by Mr. Anderson to rescind the resolution ordering abatement of the resi-
<br />dence at 955 East 43rd to be .effective only upon presentation of' plans and specifications which make
<br />it clear the house can ?e ~rought to Code and that a building permit can be issued.
<br />
<br />At the request of Councilman Wingard, the City Manager recited a resume of the events
<br />leading to the present consideration, beginning with the original intent of the owners
<br />to move the house to the Friendly Street area and including various actions taken by the
<br />Council "since the building's location at 955 East 43rd.
<br />
<br />A vote was'taken on-the motion to rescind the abatement authorization,and motion carried, Councilmen I
<br />Purdy, McNutt, Anderson, Lassen, and Mayor Cone voting aye; Councilmen Lauris, Hayward, McDonald, and
<br />Wingard voting no.

<br />Councilman McDonald left the.meeting.
