Paving and'storm sewer on Willamette from 40th to Coachman ($20,500) - The Public <br />Works Department recommended paving to 40-foot width to south edge of Breeden Bros. <br />tract with offset centerline so that if it is decided later this is to be an <br />arterial, then one side can be widened to provide the necessary width. Councilman <br />Lassen inquired if owners of properties abutting the street which do not have access <br />have been notified of the intended improvement. The City Attorney said if there is <br />no access, there is a legal question as to whether the properties are benefited. <br />If they are not benefited, they cannot be assessed. It was decided the project <br />could be approved to allow the engineering work to proceed while the assessment <br />legality is investigated, and a motion was made to that effect py Mr.. McN:utt, <br />seconded by Mr. Wingard, and carried. <br /> <br />I <br /> <br />r. Paving and storm sewer, Cambridge Park 2nd Addition ($2,000-sewer only) - Mr. Wingard <br />moved seconded by Mr. McNutt to approve. Motion carried. <br /> <br />s. Valley River Sanitary Sewer Pressure Line and Pump Station ($95,000) - It was ex- <br />plained that because of engineering problems with connecting to the 30th Avenue <br />trunk and because Federal funds won't be forthcoming for about two years, the <br />Public Works Department recommended construction of a pressure line designed to <br />serve as a lateral system and a temporary pump system in order to service the <br />Marist School and Valley River Shopping Center. The system will be connected as <br />a gravity system when the 30th Avenue trunk is completed. Mr. McNutt moved <br />seconded by Mr. McDonald to approve. Motion carried. <br /> <br />e <br /> <br />The City Manager explained that approval of the projects at this time will enable engineering work to <br />proceed. At the time of contract award, public hearings will be held and the Council at that time <br />has the authority to proceed or abandon. <br /> <br />I' <br /> <br />Mr. Anderson moved seconded by Mr. Lassen to proceed with engineering work on 3a through 3s and prepare <br />to take bids on projects for the 1968 construction season. <br /> <br />With regard to the paving on Birch Lane (f), Charles Strong, 1655 Prospect Drive, said he felt paving <br />this street wouJd create a safety hazard because of speeding cars and suggested either closing the <br />street or leaving it as it is. He asked a delay on the Council's decision to provide an opportunity <br />for owners of abutting properties to organize a ,maintenance program. The City Manager said the City <br />does not normally maintain unimproved streets, that the project is a portion of Hendricks Park improve- <br />ment to make another safer access, and if it is felt it could be maintained by owners of abutting prop- <br />erties as a private street that decision can be made at the time of contract awards so that engineering <br />work can proceed at this time. <br /> <br />,. <br /> <br />Councilman Lassen inquired about the street width. The Public Works Director said at this time a <br />28-foot width is planned, but after the design work is started an alternate may be brought back to the <br />Council. He also said there is no provision for sidewalk because of topography and only a 30-foot <br />right-of-way. <br /> <br />Councilman Lassen asked with regard to paving and storm sewer on Crest Drive (h) if the entire project <br />is inside the City limits. The Manager replied that,both sides of the street as.far as Lincoln Street <br />are inside the City, and that the street creates an expensive maintenance problem. Councilman McDonald <br />asked if the cemetery abutting the south side will be assessed, and the City Attorney explained the <br />method of assessing that property. Mr. McDonald said he felt this project should be delayed until <br />annexation of the Crest Heights area is determined. <br /> <br />I <br /> <br />With regard to the Willamette Street project (q), the City Manager said that withdrawal of signatures <br />frum the original petition had brought the percentage dO~l to 43.3% of the frontage favoring the <br />project, and that owners of 36.5% of the frontage object. Dale Ramsey, 4875 Willamette Street, asked <br />for a show of hands of those present objecting, and 13 people in the audience indicated they did not <br />want the paving. <br /> <br />e <br /> <br />Marlin Withrow, 20 East 46th Avenue, said he felt the engineering should proceed because development <br />in the area and safety factors will necessitate the street paving eventually. <br /> <br />The question of assessment arose, and the City Attorney said since there is nothing to prohibit access <br />to Willamette Street in the way of deed restrictions, the properties can be assessed for the ,improvement. <br /> <br />Mr. McDonald moved seconded by Mrs. Hayward to amend the motion deleting for separate vote the Crest <br />Drive and Willamette Street projects. Motion carried. <br /> <br />A vote was taken on the original motion as amended, ,and motion carried. <br /> <br />. <br /> <br />Mr. Anderson moved seconded by Mr. Lassen to approve paving Crest Drive. Motion carried, Mrs. Hayward, <br />Mr. McDonald, and Mr. Wingard voting no. <br /> <br />Mr. Anderson moved seconded by Mr. Lassen to approve the Willamette Street project. Motion carried, <br />Mrs. Hayward and Mr. Wingard voting no. <br /> <br />I <br /> <br />1 <br /> <br />4. Progress Payment, Danebo Fire Station - The City Manager recommended partial payment <br />of $12,648.60 to A&G Construction Company for the Danebo Fire Station., Mr. McNutt <br />moved seconded by Mr. Wingard to approve. Motion carried. <br /> <br />Mr. Anderson moved seconded by Dr. Purdy that Item 4 of the Committee report be received and filed. <br />Motion carried.
