Planning Commission Report - April 2, 1968 <br />a. Rezone Oak Patch between 15th and 18th, Chowning - The Planning Commission recom- <br />mended approval of rezoning from RA to R-2 PD, subject to agreement to ensure <br />compliance with plans, drawings, illustrations, and time schedules. Discussion <br />between Council members, Mr. Chowning, and the Planning Director brought outthat <br />a total of 118 units is allowed under the agreement. <br /> <br />Mayor Cone returned to the meeting and assumed the Chair. <br /> <br />Mr. Anderson moved seconded by Mr. McNutt to approve the Planning Commission recommendation. Motion <br />carried. <br /> <br />2 <br /> <br />b. Rezone Bailey Hill Road between 18th and Warren, Ellison and Platz - The Planning <br />Commission recommended approval of rezoning from RA to R-1 PD and C-1 PD, subject <br />to an agreement to ensure compliance with plans, drawings, illustrations, and time <br />schedules. The Planning Director said 20% of the commercial area must be con- <br />structed within two years or that portion will revert to RA. <br /> <br />Mr.Anderson moved seconded by Mr. Lassen to approve the Planning Commission recommendation. Motion <br />carried. <br /> <br />3 <br /> <br />2. Planning Commission Report - April 8, 1968 <br />a. Vacation Arthur, Cooper, Cross, Cleveland - The Planning Commission recommended <br />approval of these vacations requested by SP&S, subject to their dedication of <br />Cross Street between Foch and Garfield. There were no objections in the area, <br />and the City's traffic circulation is adequately served. <br /> <br />Mr. Anderson moved seconded by Mr. Lassen to approve the vacations. Motion carried. <br /> <br />Councilman Purdy returned to the meeting. <br /> <br />4 <br /> <br />3. Appeal, Day Nursery, 28th and McLean - A petition was presented from residents in <br />the area appealing the Planning Commission approval of a conditional use permit to <br />allow a day nursery and kindergarten at 28th Avenue and McLean Boulevard. The peti- <br />tioners' objections were based on increased traffic and impairment of operation of <br />the convalescent home to the west. Council members previously viewed the site of <br />the proposed nursery. <br /> <br />Mr. Anderson moved seconded by Mrs. Lauris to grant the permit. <br /> <br />Mrs. John Jaap, 2690 Polk; Harold Napper, 2770 Polk; Craig Lucas, 2590 Polk; Millard Sp1ane, 2630 Polk; <br />and Mrs. Frank Dunlap, 2785 Polk stated their reasons for objecting to the nursery - increased traffic, <br />devaluation of property, changing character of the residential neighborhood to commercial, no benefit <br />to the City as a whole. <br /> <br />Mrs. Frank Trocino, 5070 Donald Street, said she anticipated very little change in traffic as a result <br />of the nursery, and explained its proposed operation. David Hoffman, Planning Commission member, said <br />the Planning Commission felt this was an ideal location for a nursery and kindergarten, that very <br />strict conditions are set for suchinsta11ations, and he urged the Council to uphold the Planning Com- <br />mission action. <br /> <br />A vote was taken on the motion to approve the permit, and motion carried, Mr. McDonald voting no. <br /> <br />5 <br /> <br />4. Echo Hollow Pool - The City Manager reported the proposed time schedule for presenta- <br />tion of final drawings and revised estimates on the Echo Hollow Pool. The schedule <br />contemplates bid call by May 15 with start on construction by July 1, 1968. <br /> <br />No action was taken. <br /> <br />6 <br /> <br />5. Insurance Agent-of-Record - A report was read from the Finance Director recommending <br />appointment of Smith & Crakes as agent-of-record for the City's insurance program. <br /> <br />Mr. Anderson moved seconded by Mr. McNutt to accept the report. Motion carried. <br /> <br />7 <br /> <br />6. Oversize Curb Cut, 315 Coburg Road, Garnett - A 40-foot curb cut was requested by <br />Myr1 Garnett for the service station north of Staff Jennings property. The Public <br />Works Department recommended approval. <br /> <br />Mr. Anderson moved seconded by Mr. Lassen to approve the request. Motion carried. <br /> <br />8 <br /> <br />7. Sewer between 10th and 11th, McKinley to east - The Public Works Department recom- <br />mended approval of Iverson Paints request for waiver of bid procedure and contract <br />award to Bethe1-Danebo Sand & Gravel for $2,025.30 for construction of this sewer line. <br /> <br />Mr. Anderson moved seconded by Mr. Lassen to approve the waiver and contract award. Rollcall vote. <br />All councilmen present voting aye, motion carried. <br /> <br />9 <br /> <br />8. Harlow Road Right-of-Way - The Public Works Department recommended purchase of land <br />for Harlow Road widening from James Murphy for $30.00. <br /> <br />Mr. Anderson moved seconded by Mr. Lassen to approve.
