Mr. Elfers said that . <br />Ii he felt the basic questions were whether a road would actually be constructed on ~ <br />1 . <br />Ii the old alignment of City View, whether the Chrysler property is actually without <br />!: public access, and whether the vacations are in the public interest. <br />" <br />, <br /> <br />i: Councilwoman Hayward asked if the Council properly can make a decision in the <br />I: matter of Mr. Chrysler's using the voided vacation as leverage in gain reimburse- <br />i ment for the cost of his 1itigation. The City Attorney explained 'the City's posi- <br />;' tion with regard to the suit filed by Mr. Chrysler. He said the public responsi- <br />:1 bility is to the owners of private properties in those subdivisions platted over <br />i: the faulty vacations. <br />I' <br /> <br />In response to a question from Councilwoman Hayward, the Planning Director explained <br />the Planning Commission did not recommend vacating City View because it was not <br />clear how access would be provided to the Chrysler property. The Commission at <br />:: that time also felt agreement could be reached between Mr. Chrysler and Mr. Shi. elds <br />to provide access. The Planning Director said the Commission will consider vacat- . <br />ing the portion of City View north of Shields Avenue at its July 22 noon meeting, .~ <br />and recommended the Council proceed with calling a hearing on the matter with the <br />idea that a firm decision could be made when the hearing is held. <br /> <br />Ray Wiley, 2100 Shields Avenue, said there are 29 properties affected by nullifica- <br />tion of the street vacations, and that he couldn't understand how the Council could ~ <br />let clouding of titles continue by not vacating City View. ~ <br />: LaVerne Strand, Cascade Title Company, said Cleveland and Arthur Streets were . , <br />I' never dedicated, that they were "reserved roadways," and that any action taken at ~ <br />" this time would merely be a bookkeeping function. He said the status of City View <br />would not jeopardize the status of. Cleveland and Arthur. <br /> <br />Mr. Chrysler said he realized the City should not judge between citizens on equity <br />concerned with the public interest, but that if t4e City remained neutral he felt <br />with more time he could accomplished an agreement' with Mr. Shields, then he would <br />.. support the vacating of all three streets. He mentioned that the public land which <br />" would be vacated would revert to the subdivider and thereby be available for sale <br />:: to private owners. <br />" <br />I <br />ii The City Attorney explained that the vacation of these streets would be offset by <br />I, the dedication of other streets in the subdivision - 28th, 29th, etc. He explained . <br />!; the law with regard to a complainant's responsibility for payment of legal fees. ~ <br />" <br />I, It was understood a public hearing on the vacation would be called and action de- <br />: ferred until the date of the hearing." <br /> <br />The City Manager report that the Planning Commission at its July 22 noon meeting, reronsidered its <br />action with regard to the vacation of City View because other property owners concerned were not <br />aware of the petition when it was presented to the Commission previously. The Planning Commission <br />now recommends vacation also of that portion of City View north of Shields Avenue. <br /> <br />i' Mr. Anderson moved seconded by Mr. Lassen to call a public hearing on the vacation of portions of <br />" Arthur, Cleveland, and City View Streets. PAC Resolution, Water/Sewer Study - The Council was asked to adopt a resolution submitted <br />by the Plan Advisory Committee subcommittee on Community FaciDties, Services, Utilities <br />and Transportation wherein it was requested that any programs contemplating major ... <br />changes in existing plans for extension of water and sewer services be submitted to <br />[. the Central. Lane Planning Council' for review and comment in the context of the com- <br />I. prehens~ve area-wide sewer and water study now being developed.' <br /> <br />Mr. Anderson moved seconded by Mr. Lassen to adopt the resolution. Motion carried. <br />:1 <br />, <br /> <br />2 I 2. Prairie Road Transfer - The City Manager reported that it has been determined there <br />is no order by the Public Utilities Commissioner for a grade separation crossing at <br />Prairie Road and the railroad tracks south of the planned realignment of Maxwell Road <br />to Highway' 99N. He recommended acceptance of jurisdiction from Lane County of <br />I Prairie Road between Maxwell Road andHighway 99. <br /> <br />, Mr. Anderson moved seconded by Mr. Lassen to approve the recommendation. Motion carried. .~ <br />: ~ - <br /> <br />3 3. kssessment Segregation, Sprague at West Amazon, Cummins - Delano A; Cummins requested <br />segregation ?f $502.27 from the assessment against his property at 4810 ~prague Street, ~ <br />leaving a lien balance of $907.18 (Job 66-14, File S-68-J). . <br /> <br />I, Mr .Anderson moved seconded by Mr. Lassen to approve thersegregation. Rollcall vote. All councilmen <br />II present voting aye, motion carried. <br /> <br /> <br />4 4. Package Store Class B License, K&T Market at 2480 Alder Street, submitted by Archie and <br /> <br />Doris Clausen as approved by the Police Department. The application covers a change of <br />ownership - formerly-Stop 'n Shop Market licensed to William W.
