<br /> ~330 <br /> .. <br /> 8/12/68 <br /> State Milk Law - ,The City Manager said an' .amendment changing the wording of. the State ,i <br /> 1 5. . <br /> law governing milk inspection would allow the City, by ordinance, to prohibit the sale ;/ <br /> of raw milk within its boundaries and discontinue, its milk inspection service. <br /> Mr. Anderson moved seconded by Mr. Lassen to introduce a bill in the next session of the Legislature <br /> to amend the State milk law. Motion carried. <br /> Councilwoman Lauris returned to the meeting. <br /> 2 6. Protest, Southern Pacific Service - A l~tter was read from Thomas A Beaumont, student <br /> at the University of Oregon fromSeattle, asking the City to protest the discontinuance <br /> of Southern Pacific Cascade passenger service. The City Manager presented information <br /> received from the Southern Pacific with regard to intrastate baggage service and statis- <br /> tics concerning am~unt of ~aggage.ha~dled at Eugene. <br /> Mrs. Lauris moved seconded by Mr. Wingard to enter a formal protest against any further discontinuance <br /> of passenger or baggage service by the railroads. Motion carried. .' <br /> 3 7. SP&S Co~operation with City - A lette~ was presented from Spokane, Portland and Seattle <br /> Railway in answer to a protest previously authorized by the Council on lack of Oregon <br /> Electric co-operation with the City. The letter indicated Oregon Electric felt the lack <br /> of co-operation was on the part,of the City. It was understood the matter would be handled <br /> at the staff level., .~ <br /> No action was 'taken. .~ <br /> ORDINANCES <br /> 4 Council Bill No. 8586 - Vacating easement west of Patterson Street and s~uth qf East 'Broadway <br /> (College Inns), was submitted and read in full. <br /> I Letters of pr.otest were presented from Floyd and Willa McAllister, 1010 West Hilliard Lane, and <br /> Elizabeth Ann Cully, 962 Ferry Lane. <br /> The Public Works Director explained that the sewer on the easement was bandoned when a new sewer line <br /> was developed' on Patterson Street to se!ve the College Inns building. The easement is completiy within <br /> the boundaries of ColLege Inns ownership. He said previous legal opinions were that Ferry Lane, serv- <br /> ing the property from the west, is a private street, and there is a law suit now pending to determine iI <br /> ',3, <br /> whether it is private. <br /> Scott Lawlor, attorney representing Ann Cully, said the easement was used in prior years for vehicular <br /> service to the College Inns building. Ferry Lane is now being used for this purpose, he said, and his <br /> client is attempting to restrain this use through court.action.. He asked postponement of action on <br /> this vacation request until after August 16 when the suit will be tried, so that ,the owners of College <br /> Inns will not come into court without easement rights. <br /> Dr. Purdy moved seconded by Mrs. Lauris to table 'the council bill for two weeks. Motion carried. <br /> 5 Counc'il BUI No. 8587 - Vacating sewer easement north of Mahalo Drive west of Manzanita Street' ., <br /> (Dills), was submitted and read in full. <br /> Mr. Anderson moved seconded by Mr. Lassen that the bill be read the second time by council bill number <br /> , ' ' <br /> only, with unanimous consent of the Council. Motion carried unanimously and the pill was r~ad the <br /> second time by council bill number only. <br /> Mr. Anderson moved seconded by Mr. Lassen that the rules be suspended and the bill read the third time .. <br /> by council bill number only, with unanimousconsent of the Council. Motion carried unanimously and the <br /> bill was read the third time by council bill number only. <br /> Mr. Anderson moved seconded by Mr. Lassen that the bill be approved and given final passage. Rollcall <br /> vote. All councilmen present voting aye, the bill was declared passed and numbered 15404. <br /> 6' Council Bill No. ,8588 - Vacating alley between 12th Avenue and 13th Avenue from Hilyard Street <br /> east (Sacred Heart), was submitted and read in full. <br /> Mr.:. Anderson moved seconded by Mr. Lassen that the bill be read the second time by council bill number <br /> only, with unanimous consent of the Council. <br /> Councilman McDonald informed other Council members he would vote "no" on this bill, thereby delaying -<< <br /> final action in order to give the petitioners an opportunity to disc~ss the change in the assessment <br /> amount. <br /> Councilman Wingard said he felt the reason for a high appraisal 'on this land was due, to pressure . <br /> exerted by Hospital purchases in the area. He.said he felt $2.00 per square foot would have been a <br /> realistic price for the land, and he moved that the assessment charge be reconsidered. There was no <br /> second. . <br /> The City Manager said passage of the vacation ordinance could proceed, since it wouldn't be effective <br /> until it was signed by the Mayor - or the Mayor could veto it - then the matter of assessment could be <br /> reconsidered. <br /> ',' <br /> .~ <br /> l 8/12/68 - 20 <br />
