Alley Vacation between 12th and 13th east from Hilyard, Sacred Heart - A letter from <br /> the Administrator, Sacred Heart Hospital, was read requesting waiver of proposed <br /> charges for vacation of this alley. It was explained a public hearing was set for <br /> August 12,1968 and that under normal procedures an estimated is made of the value of <br /> the land to be vacated and assessed against the benefiting property. The Manager said <br /> a value of $3.80 per square foot has been placed on the land by the Public Works De- <br /> partment, based on recent sale of adjacent property, making a total of $7,098.88 for <br /> the land to be vacated. The basis of Sacred Heart's request for waiver was that the <br /> alley to be vacated deadends and does not serve as a public thoroughfare and does not <br /> represent an investment of public funds. <br /> Mrs. Lauris asked if a pedestrian way would be provided when construction of the <br /> Hospital's new wing is completed and was told byMr. Williams there would be. <br /> Some discussion took place with regard to the triangular piece of City-owned property <br /> at 13th and Alder used by the Hospital for parking, and the normal procedure of assess- <br /> ing value of vacated land unless dedicas ion of like value is received. <br /> . <br /> Mr. Anderson moved seconde~ by Mr. Lassen to waive one-half of the proposed assessment, <br /> charging $1.90 per square foot for the land to be vacated. Motion carried, Mrs. Lauris <br /> voting no. <br /> ,It Mr. Anderson moved seconded by Mr. Lassen to approve Item 6 of the Committee report. <br /> Mayor Cone questioned whether to reduce the appraised cost for the vacated land. Councilman Lassen <br /> . asked if there have been other instances that would compare, and the Manager replied there appeared to <br /> be none where no assessment was charged unless land of equal value was dedicated, or where property <br /> was returned to a recently filed plat when it was decided a street or alley was not needed. The <br /> policy of assessment has been in effect only since 1961, he said, so there may have been vacations <br /> without payment before that time. Councilman McDonald said it was his, understanding the alley has <br /> never been used by the public. The Public Works Director said the alley was improved with assessment <br /> to owners of abutting properties prior to the time it became surrounded by one ownership. <br /> ~ouncilman Purdy returned to the meeting. <br /> Mr. Anderson with consent of the second changed his motion to proceed with vacation of the alley and <br /> charge the full amount of the appraisal ($3.80 per square foot). Rollcall \0 te. All councilmen pres- <br /> . ent voting aye, except Councilman McDonald voting no, the motion carried. <br /> Other items on August 8, 1968 committee agenda not considered at that time: <br /> 2 1. Variance, Small Animal Clinic, Villard Street - Gordon York requested further extension <br /> of the variance granted two years ago allowing a small animal clinic on Villard Street <br /> near Garden Street. He said the University of Oregon will purchase the property upon <br /> which his existing clinic is located, and the variance extension will allow time to com- <br /> plete the transaction before a new building is constructed. <br /> Dr. Purdy moved seconded by Mrs. Hayward to grant a one-year extension of the variance. Motion carried. <br /> II 3 2. Minda Drive Right-of-way and Paving - In working with the contractor to develop a change <br /> order covering specifications for paving one-half of the right~of-way on Minda Drive <br /> between Norkenzie and Gilham, it appears that this plan will add about $1200 to the cost <br /> of construction. In the meantime it has become possible to purchase fbr $1100 the neces- <br /> sary right-of-way to pave the full width. Paving, sewer, and curb and gutter costs will <br /> be assessed against the owners of all abutting properties. <br /> . Dr. Purdy moved seconded by Mr. Anderson to buy the right-of-way for $1100 and pave the full width~' <br /> Rollcall vote. All councilmen present voting aye, motion carried. <br /> Councilwoman Lauris left the meeting. <br /> 4 3. Paving Alley between 32nd and 33rd, Willamette and Donald - Petitioned by owners of <br /> 62.2% of property to be assessed. The Public Works Department called attention to <br /> the special assessment requirement whereby Mr. John Hirons anticipated paying the en- <br /> tire cost of the alley improvement. <br /> Mr. Anderson moved seconded by Mr. Lassen to approve the petition. Motion carried. <br /> . 5 4. Buckley House - A proposed agreement was presented covering payment of funds budgeted <br /> for Buckley House. The City Manager explained that the Lane County Council on Alcoholism <br /> has not developed a program to where they are providing services similar to that provided <br /> . by Buckley House. He recommended approval of the agreement which provides for quarterly <br /> payment of the monies budgeted for this purpose. <br /> Mr. Anderson moved seconded by Mr. Lassen to approve the agreement.
