He suggested the first meeting be for present Council members, Mayor Cone, City <br /> Manager, and City Attorney to outline subject areas to cover and prepare an agenda for the ensuing <br /> meetings. The City Manager was requested to prepare a survey of items considered by the Council. <br /> 1 4. Petition, Sewer Construction Practices and Assessment Procedures, Palomino Drive _ <br /> A petition from residents of Palomino Drive was read requesting that the City re- <br /> pair damage to sidewalks and restore them to the condition existing prior to sewer <br /> construction on the street, and that the City adopt policies which will result, in <br /> more equitable treatment of property owners on similar projects where assessment <br /> does not take into account the greater damage to properties on the side of a street <br /> on which the sewer is constructed. Also read was a report from the Public Works De- <br /> partment outlining contract requirements and listing items to be corrected by the <br /> contractor prior to release of the project. <br /> Mrs. Robert Abel, 307 Palomino Drive, and Mrs. Justin Sauntry, 235 Palomino Drive, <br /> said property owners were not informed of many other factors involved in the sewer <br />f construction which should have been brought to their attention. They described <br /> the condition of the sidewalks in the area and asked if the City would be responsible <br /> for repair of future damage resulting from present conditions. Considerable dis- <br /> cussion followed with regard to the contractor's responsibility and those items <br /> felt to have been in existence prior to construction, whether pre-existing condi- <br /> tions can be documented, how to determine if present conditions could result in a <br />. dangerous condition or damage to the usefulness of the sidewalks. <br />. Mrs. Lauris moved seconded by Mr. McDonald to hold to the list of items prepared by <br />~'" the engineers to be completed by the contractor and take note of suggestions in' the <br /> petition for information on future projects. Motion carried. <br /> ~. Anderson moved seconded by Mrs. Lauris to approve Item 4 of the Committee report, with the under- <br /> standing additional items prepared by the Public Works Department would be tnc1uded. Motion carried. <br /> , , <br /> 2 5. Pay for Unused Sick Leave - Fire Fighters Local 851 requested reimbursement for un- <br /> used sic~ leave for employes who retire or otherwise terminate employment with the <br /> City under honorable conditions. The City Manager explained that the entire manual <br /> on employe rules and regulations is being rewritten, and he recommended that the <br /> Fire Fighters' request be considered by the Council when the other regulations are <br /> considered. He said that at this time the recommendation would be not to treat sick <br />I leave as earned income, but the policy on this item would be better discussed at the <br /> same time other rules and regulations are discussed. <br /> Pat Flynn asked that the Council consider the sick leave policy since, he said, <br /> there is none at the-present time, and called attention to changes in the rules <br /> and regulations which were first presented about 18 months ago and have not yet <br /> been a matter of discussion. <br /> The City Manager read the policy which exists as a part of the present employe manual <br /> and which states that sick leave is provided as an insurance against an employe's <br /> illness or inability to work and is in no way to be used for any purpose other than <br />- actual illness or accident causing personal disability. He said the Fire Fighters <br /> were contacted by letter asking them to document why this policy change should be <br /> considered, but the only response was to ask that it be considered by the Council. <br /> Frank Jackson also called attention to the delay in rewriting the employe rules and <br /> regulations. The Administrative Assistant eXp;lained the procedure followed in re- <br /> writing the manual. He said it has now been reviewed by the staff and department <br /> heads and is being printed for distribution and review by the employes themselves. <br />. No action was taken. <br /> Mr. Anderson moved seconded by Mrs. Hayward to receive and file, Item 5 of the Committee report. <br /> Patrick Flynn requested that any change in the policy which results in payment for unused sick leave <br /> be made retroactive to the termination of Mr. Richard Small who left City employment May 1, 1968. <br /> Mr. Flynn said the request for change in present policy was initiated at the request of Mr. Small. <br /> The City Manager said there would be no objection to including consideration of Mr. Small if any <br /> change in policy is made. <br /> A Vote was taken on the motion to receive and file. and motion carried, Mrs. Lauris voting no. <br /> 3 6. Central Eugere Proiect - The public hearing on the relocation plan for the Project <br />. scheduled for Noverrb er 20, 1968 has been cance Ued. if <br /> The Committee report, Item 6, was received and filed. <br />. David Hunt, Renewal Agency director, explained the status of the application for funds. He said the <br /> Agency is fairly sure the Department of Housing and Urban Development will approve the application, <br /> and the public hearing will be rescheduled, probably in December, when notice of approval is received. <br /> Other items on the November 7 Committee agenda not considered'at that time: <br /> . <br /> 4 1.
