See Item 1, Page 133. <br /> <br />b. <br /> <br />Non-conforming Uses - Mrs. Hayward said she had received many calls from people <br />owning property with non-conforming uses, concerning letters received from the <br />planning office. Mr. Mortier explained that the new zoning ordinance sets cer~a~n <br />cri teria on non-conforming uses to establish status with regard to an amortization"..,... <br />period. The Planning Commission has initiated action to start public hearings. The <br />action- taken will depend on the hearing. The Planning Commission may take action <br />to legalize the use by conditional use permit. <br /> <br />c. <br /> <br />Dog Control Ordinance - Dr. Purdy. has received a number of phone calls on the Dog <br />Control Ordinance and has invited two constituents to speak. <br /> <br />e <br /> <br />Mrs. Da~e Peterson, 2423 Pioneer Pike, was concerned about the amount of the impound- <br />ing fee, and the fact that' no warnings will be issued. Most dogs are children's <br />pets, and accustomed to running with the children. It is very difficult to say at <br />what point a dog is running at large. Mrs. Peterson also felt written warnings should <br />be issued, and that, after two complaints, the owner could be taken to court. <br /> <br />I <br /> <br />Mrs. Howard Skjei, 860 Pioneer Court, agreed that the impounding fee was too high. <br />She did not think laws should be enacted which would only be enforced in certain <br />sections of the city. <br /> <br />Mrs. Hayward sympathized with the ladies, but explained that peopl~ who have <br />complaints about animals also have to be listened to, and all complaints must be <br />given attention. <br /> <br />Mayor Anderson said the Council recognized problems involved in enforcement,. but <br />explained that the ordinance has been designed to eliminate particular nuisances when <br />they; occur. The ordinance is not directed at khe child with a dog. <br /> <br />Mrs. Hayward said dogs should be on leashes when outdoors and that children can be <br />trained to keep their dogs on leash when 'they take them o.ut. <br /> <br />Mr. Anderson explained that the Council can modify the ordinance if it appears <br />injustices have occurred. A person always has the right to appeal to a court of law. <br /> <br />Mrs. Beal thanked the ladies for appearing, and explained that many persons had com- <br />plained, but none had appeared before this time. <br /> <br />I <br /> <br />Mrs. Peterson asked that the ordinance be amended to require written complaints before <br />a dog could be picked up. The Manager explained that, as now written, the ordinance <br />does not require a complaint, and any dog off owners property not on a leash is in <br />violation and can be picked up. A police patrolman has the authority to issue a <br />citation to the owner of a dog if he knows who the owner is, without having to pick <br />the dog up. The owner would be brought into municipal court and would have to answer <br />to the citation. Complaints are not necessarily from anneighbor, but could be from <br />the dog control or police. officer. <br /> <br />e <br /> <br />Mrs. Skjei asked that the Humane Society send writte.n notice .to a family before a <br />dog is put away. Mrs. Hayward explained that the Council feeling was that a famiJY <br />who really cared about a dog would call the Humane Society as soon as p dog was missing. <br />This was the main reason for posting notices at the Humane Socie.ty, rather than at <br />City Hall. <br /> <br />The Manager said there has been considerable newspaper publicity concerning this law, <br />and there will undoubtedly have to be more. <br /> <br />Mrs. Hayward moved seconded by Mr. McDonald to receive and place on file Items lb and lc of the <br />Committee report. Motion carried. <br /> <br />d. Rev:okable Permit, L. R. Jarrard - The Manager presented a request from Mr. L. R. Ja.rrard <br />to build a retaining wall on city right of way at 3190 West 18th Avenue. The staff <br />recommends approval. <br /> <br />Mrs. Hayward moved seconded by Mr. Gribskov that the Council grant a revokable permit <br />to Mr. Jarrard, subject to removal at the City's request. <br /> <br />I <br /> <br /> <br />,,"-,- <br /> <br />The Manager suggested that an ordinance be drafted to allow the staff to make <br />decisions on matters of this kind instead of coming to the Council with them. The <br />Council concurred. <br /> <br />Mrs,. Hayward moved seconded by Mr. McDonald that Item ld of the Committee report be approved. <br />Motion carried. <br /> <br />e <br /> <br />e. City Employes Health Program - Mr. Mills has distributed copies of specifications as <br />they were sent to various insurance companies.. Low bidder was Washington National, <br />and staff recommended they be designa.ted as..carrier for the city plan.
