<br />Mr. James Pearson, Planning Commission member, said the criteria mentioned by Mr. Bennett
<br />were not contained in an ordinance, but were a Planning Commission policy statement for
<br />Planning. Commission or applicant's guidance. The policy was established in 1964, and was
<br />updated before this application was approved. Mobile home construction and the concept of
<br />mobile home park development have changed considerably, necessitating updating of the
<br />policy. 1

<br />Mr. McDonald moved seconded by Mr. Teague that the City Council uphold the recommendation
<br />of the Planning Commission and approve the change of zone from AG to RA on property
<br />located between Royal Avenue and Barger Drive, west of Candlelight, and the Conditional
<br />Use pre-preliminary site approval. Motion carried.

<br />side of Agate Street, south of 19th. Appeal to Conditional Use Permit.

<br />A public hearing on application for zone change was scheduled for the meeting of December
<br />22, 1969. Because of an appeal from the Conditional Use Permit granted by the Planning
<br />Commission to permit a den.tal clinis; on. the prdlperty, the Council postponed _
<br />the zone change hearing so that it could be heard in conjunction with the conditional
<br />use appeal.

<br />In answer to Mr. Mohr, the City Attorney said the decision on a zoning classification
<br />must be made on grounds other than refusal to rezone to hold for future public use.
<br />Mr. Mohr suggested that opponents and proponents should not speak to the issue of
<br />holding the property for future park use.

<br />Mr. Bert Pinkerton, 1972 Emerald, said this is a declining neighborhood, in need of a
<br />shot in the arm. He felt a clinic, properly landscaped, would provide a buffer-strip
<br />between commercial and residential.

<br />Mrs. Francis Drury, 1646 East 19th, said the back yards of the rental houses on the pr.operty
<br />faced her house, and it was her opinion the clinic would improve theneighborhood.

<br />Mr. H. R. Axtell, 1985 Friendly Street, said he owned one of the lots adjacent to the park,
<br />and that three previous zoning requests had been before the Council. He presented a peti-
<br />tion favoring the rezoning which, he said, represented a cross section of the southeast
<br />section of town.

<br />Mr. John Reynolds, architect, said that the Pllanning Commission had arrived at the answer
<br />that the petitioners request was the best use of. this. land, and their judgment should
<br />be considered.

<br />Mr. Ed Whitelot asked for an explanation of what precluded this property from being
<br />made into a park. Mrs. Hayward explained that the city could not refuse to rezone the
<br />property to a higher use in order to keep it at a low value until it could budget
<br />money to purchase it for park purposes.

<br />Mr. Jack Craig, 2159 Emerald, Mr. Walter Miller, 2176 Agate and Mr. Michael Ewing, Rt.
<br />3 Box 83 Springfield, felt the public would benefit from the City buying this",for'park
<br />purposes, and tha t theCi ty should arrange to b~lY it.

<br />Mr. Marvin Krenk, 2100 Eaton Drive, was puzzled by the conditional use attached to the
<br />RG designation. City Manager explained that the applicant had requested rezoning to RP
<br />to permit dental offices, but the Planning Commission was concerned that other businesses
<br />allowed under this classification would not be suitable. With "the RG zoning the dental
<br />clinic"would be allowable under conditional uSe, but no other commercial uses would be
<br />allowed.

<br />Mr.G-lyde Patto,n;2l60 Onyx, felt zoning should be decided by the community as a whole,
<br />not by request of buyer and seller.

<br />Mr. Craig said he bad lived, in this area for twenty years, and felt nothing but residential
<br />should be allowed on this property. He feared the whole block would become commerc~a1.

<br />Mrs. Sylvia Schumacher, 1800 Columbia Street, suggested that if the Council rezoned
<br />this property, she would like hers rezoned too.

<br />Mr. Al Urquhart, 1960 Agate, said he had appealed the decision for a Conditional Use
<br />Permit. He presented a petition signed by 515 persons. It was his opinion' that" there
<br />was sufficient commercially zoned property in this area, and that reasons for this
<br />request were purely economic. He felt that, since the property was adjacent to a park,
<br />it should be used as an extension to provide a needed playground. He explained that
