<br />Regular meeting of the Common Council of the city of Eugene, Oregon was called to order by His Honor
<br />Lester E. Anderson at 7:30 p.m. on February 9, 1970 in the Council Chamber, with the following
<br />Councilmen present: Mrs. Hayward, Dr. Purdy, Messrs. McDonald and Teague, Mrs. Beal, Messrs. Mohr
<br />and Williams.

<br />Minutes of the meeting held January 26, 1970, were approved with the following correction:
<br />
<br />"Page 3, Paragrpph 5, vote on amendment should be reversed, and delete Mayor's vote, since
<br />he did not vote on the motion"
<br />
<br />Parks Department Award
<br />Manager displayed placque' received by Parks and Recreation Department for Grand Award Winner in
<br />Class III of 1969 Gold Medal Award competition for excellence in Park and Recreation management.
<br />This award was presented by the National Sports Foundation.
<br />

<br />The Director of Parks and Recreation explained that Class III included cities with a population from
<br />50,000 to 100,000. The placque was accompanied by a $1,000 prize.
<br />
<br />Mayor Anderson congratuled Ed Smith, P~ks Director, and the Parks Department, for their fine work.

<br />Meeting held January 28, 1970:

<br />a. Announcements - Mayor Anderson announced the appointment and acceptance of Mr. Tom Williams
<br />to the Joint Housing Committee.

<br />Councilmen Williams, Mohr and Purdy were appointed to a committee to consider proposals
<br />of the Firefighters concerning time off for holidays. Mr. Mohr will act as chairman.

<br />Mr. McDonald moved seconded by Mr. Teague to receive and place on file Item la of the Committee
<br />report. Motion carried.

<br />b. Liquor Control Commission - Mayor Anderson reported on his meetin~,with the Liquor Control
<br />Commission. He previously distributed to the Council copies of a statement by the Commission
<br />which was presented to him when he came before them. He said it was unfortunate that the
<br />conversation at the meeting did not take a very constructive note,-and they never really
<br />got down to discussing this particular statement. He pointed out that some of the things
<br />the Council had s ~gested were included in the statement, but they did not at the meeting,
<br />indicate any inclination to develop guidelines. The Mayor recommended that the Council wait
<br />for further developments.

<br />Mr. McDonald moved seconded by Mr. Teague to receive and file Item lb of the Committee report.
<br />Motion carried.

<br />c. Peti~ion, Skinner Butte Cross - Mayor Anderson commented that the Council, by not taking
<br />action at the last Council meeting, had felt the petition to designate the cross a war
<br />memorial would appear on the ballot at the "next election". A question arose as to
<br />what would constitute the "next election."
<br />

<br />The City Attorney said he would address himself to this question at a later date, since
<br />he had corresponded with the SeGretary of State and Attorney General requesting inter-
<br />pretation of the statute pertainigg to placement of a charter amendment on the ballot.
<br />The Council could set a special election if it placed the measure on the ballot, but
<br />since it "did not, there is a question of interpretation of the statute.
<br />
<br />The City Attorney distributed a memo to the Council regarding date of election for initiative
<br />measures presented to the City Council for action prior to February 26, 1970. After reviewing
<br />appropriate sections of State law." City Charter and Code, the Attorney found initiative measure
<br />may be placed on the election ballot of the first election more than 90 days after presented to the
<br />Council. Since Eugene does not automatically have a primary election, it will be necessary for the
<br />Council to enact an ordinance establishing a special election. Otherwise, any initiative measures
<br />will not be on the ballot until the November election.

<br />Dr. Purdy moved seconded by Mr. McDona~d that the City Council declare May 26, 1970 the date of a
<br />special City election.

<br />Mr. Oral Robbins, Commander, Eugene Post #3, American Legion, said they had passed petitions for
<br />signatures, and had told signers the election would be in May. He requested the City Council to
<br />pass this motion, so that an election could be held at that time.
