Based upon information which was examined by the City Attorney's office and <br />Finance Department, staff recommends D G D Backhoe Service bid be disallowed and not <br />considered as the lowest bid, and the bid be awarded to Kenneth R. Bostick. <br /> <br />Mr. Teague moved seconded by Mrs. Hayward that on Sections a, band d the D G D Backhoe <br />Service Bid be disallowed and that they be awarded to the next lowest bidder, Kenneth R. <br />Bostick Construction Company. <br /> <br />II <br />I <br /> <br />Councilman Williams said he was aware the City had had problems with D G D Backhoe Service, <br />but he was concerned that the City would be penalizing property owners by assessing them <br />the additional $10,000 quoted by the next lowest bidder. He felt the low bidder would, in <br />all probability, now conform with the law. Manager agreed that this was a valid question. <br />He explained that this company had deliberately signed wage certificates which were not <br />true, and it was felt the bid should be disallowed as not responsible. <br /> <br />II <br />I, <br />II <br /> <br />Councilman Williams felt this action would be tantamount to assessing a penalty without due <br />process of law. He felt there should be a provision to penalize a contractor who does not <br />fulfil his obligation. City Manager said action for violation of the law would be taken by <br />the District Attorney. Assistant City Attorney said the question before the Council is that <br />of policy - whether or not someone who apparently knowingly. filed false statements3with the <br />city of Eugene is an individual the City wants to do business with. <br /> <br />There was further discussion about how the City had determined the company had filed false <br />statements, and what other remedial action the city might take. <br /> <br />Mr. Donald Heer, owner of D.
