:I Council Bill No] 9228 - Rezoning to M-2 property located at the corner of Bailey Hill and
,I
" Stewart Road (Darrel Lanz) was submitted and read in full.
:1
il
"
:1 This item was postponed at the request of Mr. Lanz. The Planning Commission recommended denial of
'I
" the request to construct a cabinet shop on this property. A joint meeting of the Council and the
Pi
Planning Commission was held subsequent to the Council meeting and the Planning Commission again
recommended denial.
Mr. William Wheatley, attorney representing Mr. Lanz, said that the property is almost surrounded
by M-2 and that this would be a logical change. He said that the Planning Staff had recommended
approval, and that it would be in conformity with the 1959 General Plan. He explained that Mr. Lanz
II would be agreeable to controls regarding buffering and landscaping, and would agree to a conditional
,I
'i use, rather that outright zoning.
il
,I Mr. Theo Yang, a graduate student in architecture, exhibited preliminary drawings of the site and of I
'I
I! the proposed shop. He said that the proposed 1990 General Plan indicates that this property is
:1 located in an area which should Light Industrial or PUD. He had kept adjacent property owners in
1\ mind when doing the plan. He explained methods to provide sight barriers. He said that it would be
:/ reasonable to grant this request.
I
II
"
,:
,I Mr. Sam Peters, 3786 Stewart Road, said that this was a residential area, and felt that rather than
i/ dying since'the 1959 plan, it had built up, and he outlined the number of hew residences built in
:t .-
i' the last four years.
'I
I'
,I The Planning Director said that the Planning Staff had recommended to the Planning Commission that
:j
!I this property should be rezoned, as this would be consistent with the 1959 General Plan, which they
'i
II are obligated to follow. The Commission felt that an overriding factor in the 1990 Plan indicated
,I
'I there was sufficient land zoned commercial or industrial, and that much of it could be reclassified
II
II residential. He said that industry is expanding in the area, and that it would be difficult to make
:1
il the area compatible. If the Council approved this request a contract could be drawn, or the Council
II could require a conditional use permit.
II
!I Councilwoman Hayward had strong reservations about rezoning this particular property, and felt that
il there were certainly other uses for it. There had been strong objection from residents of the
neighborhood, and the Council would be doing them a disservice to change the zone.
'I
"
': I
" Mr. Teague moved seconded by Dr. PUFdy to uphold the Planning Commission's recommendation and to
'I
:1 deny the request for rezoning of this property to M-2. Motion carried. I
:1 Quaker Street from 110' north of 15th to 18th; and all streets in Quaker Park Addition (68-62) was
I submitted and read in full.
II Mr. Teague moved seconded by Dr. Purdy that the bill be held over to the meeting of July 27, 1970 to
i
I, allow proper notice of assessment to be given owners of the affected properties. Motion carried.
