State Speed Control Board, Restudy - At Council request staff recommended that the State <br /> I, Speed Control Board restudy speeds on Hilyard from 33rd to 40th from Hilyard to Will- <br /> amette. It was the decision of the State Board that speeds proposed in March be retained. <br /> It was Council consensus no further recommendation would be made. <br /> Mayor Anderson questioned whether State Speed Control Boards ho~ds public hearings. <br /> Manager said they have public meetings and suggested the State be contacted for <br /> the date of the next meeting so that interested citizens may appear. <br /> Mrs. Hayward moved seconded by Mr. Mohr to direct the staff to inquire when the next <br />e public meeting of the State Speed Control Board would convene. Motion carried. <br /> Mr. Teague moved seconded by Mrs. Hayward to approve Item 7 of the Committee report. <br /> Councilwoman Hayward had understood interested people living in the vicinity of 40th and Hilyard <br /> were to be notified. Manager said this had not been mentioned, but it could be done if the staff <br />I finds the State holds public hearings. <br /> Vote taken on motion as stated. Motion carried. <br /> 8. Mass Transit, Request for Continuation of Subsidy - The City Manager explained that the <br /> Mass Transit District is not yet in a position to begin operation of the transportation <br /> system. Therefore, the City ms been requested to continue bus service through the <br /> month of September on the same basis it has been operating. The Mass Transit District <br /> will assume responsibility for such cost for the month of September and will reimburse <br /> the City at the end of that month, on receipt of a statement. <br /> r It was agreed the City should continue in this maRner. <br /> Councilman Mohr asked about the referendum procedure relating to the Mass Transit <br /> Board, and whether the Council could initiate a measure to be placed on the ballot. <br /> City Attorney said the City Council had no authority to do this. <br /> Mr. Teague moved seconded by Mrs. Hayward to receive and file Item 8 of the Committee report. <br /> Motion carried. <br /> Meeting held September 9, 1970: <br /> 'Present: Councilmen McDonald, Beal, Mohr, Hayward and Purdy; City Manager and staff; <br /> and others. <br />I 1. Siting of Buildings, University Area - Councilwoman Beal developed an addendum to the <br /> agreement between the University and the City regarding vacation of 13th Avenue which <br /> suggested consultation between the University and the City when building sites are <br /> being decided. Manager suggested this be considered separately. It has been forwarded <br /> to the Planning Department for recommendation and report, since they have previously <br /> worked with the University on building siting. This will be brought to Council as soon <br /> as the Planning Department has reported. <br /> I. <br />e Mrs. Beal was concerned that the University staff is not always coordinated and <br /> she was anxious the State Board of Higher Education would proY-ide an opportunity <br /> for city review prior to building site determination. <br /> 2. Collective Bargaining Report ~ City Manager reported that collective bargaining had <br /> proceeded with the Firefighters with fairly good results until September 4. At <br /> that time the 30 day deadline set by the firemen expired and the firefighters <br /> declared their intention of going to arbitration. Manager believed the 30 day <br /> period was insufficient for initial bargaining and that agreement could have been <br /> achieved within a very short time. Under the charter amendment the City would <br /> be required to appoint an arbitrator. Manager has instructed the City Attorney to <br /> proceed with filing of suit to contest the Charter Amendment on grounds it is <br /> contrary to state law and has a number of weaknesses which make it legally <br /> unacceptable. <br />I Dr. Purdy asked if staff was negotiating with both maintenance workers and <br /> firefightevs. Manager said AFSCME has not yet submitted a letter requesting <br /> bargaining. There are still several months before this request must be submitted. <br /> They are probably watching developments with firefighters. The Police Benevolent <br /> Association has asked to be recognized as bargaining agent and PERB has been <br /> requested to determine a bargaining unit. This procedure will continue very <br /> shortly. <br /> In reply to Councilman Mohr the City Attorney said the City is requesting declar- <br />e atory judgment that the char~er amendment is void. . <br /> - 9/14/70 - 6 <br /> ~ <br />
