<br />Mr. williams moved seconded by Mr. Mohr that a public hearing for appeal to the
<br />decision of the Planning Commission 'regardingPACT Action for Development planned
<br />unit development be set for March '8, 1971 at 7:30 p.m~ in the Council Chamber.

<br />Councilman Hershner pointed out that a partner in his law firm represents the
<br />appellants, and he would refrain'from'discussion"or voting on this matter.

<br />Councilman Mohr was concerned with the procedure of hearings on appeals and asked
<br />to discuss a policy. It was his feeling the record had already been made, and that
<br />debate should thus be limited.

<br />Mr. McDonald and Mrs. Beal felt the Council represented the citizens, and that they
<br />should be given an opportunity to state their case before that body.

<br />Mr. Teague suggested that a time limit could be set to hear each side.

<br />Councilman Williams asked if, for Council information, the City Attorney could
<br />prepare a paper dealing with specific criteria upon which the decision of the Planning
<br />Commission might be reversed.

<br />Mayor Anderson felt a full-scale public hearing was in order, and he felt the Council
<br />had an obligation to study the Eugene Community Goals policy regarding low income
<br />housing. He suggested that the Manager or City At~orney communicate with the attorney
<br />for the appellants and set some guidelines as far as discussion was concerned. approve

<br />Authorization, Purchase of Property - Option, West Amazon Right of Way, 1340 Garfield -
<br />Mr. George Keating has purchased property for development, and later discovered it
<br />was located in the proposed Amazon Espressway right of way. He has been most
<br />cooperative with the City in trying to straighten out the problem. Staff has requested
<br />authorization to purchase this property for Mr. Ke~tingss cost of $2375. It would cost
<br />several times this amount to purchase the property after it had been developed.

<br />Mrs. Beal moved seconded by Mr. Mohr that staff be authorized to complete nego-
<br />tiations for purchase of property located at 1340 Garfield.
<br />
<br />In answer to Mr. Teague, the Manager said a building had been located on the property,
<br />but Mr. Keating was in the process of removing it. This was actually a service to the
<br />City.
<br />
<br />Mr. Keating explained that $2375 was a tentative fmgure. They will ask for their
<br />actual disbursement on the property.
