<br />Mrs. Doreen Malone, Greenhill Drive, said the noise echoed in the hills, and that she had been
<br />living there twenty years, but it was no ,longer pleasant to Ii vein the country, and they could
<br />not invite friends on the weekend because of the noise.

<br />Mrs. Edward Glanz said she lived on Danebo Avenue directly across from the strip. She was not
<br />at all against the track, and felt it was of definite benefit to young people, and that it was
<br />something needed by the City. She felt it was well-organized and had to abide by the rules.

<br />Mike Groshong, speaking for Balboa, said he had worked there for five years. He explained ,
<br />the number of races run during the week, and how many had continued after 10:00 p.m. He explained:
<br />the reasons for delay at some times" and said they plan to start one-half hour earlier, and
<br />perhaps one hour earlier, so that they will have no problem with cessation of the races before
<br />10:00. He explained the efforts made to increase parking facilities, and that there had been no
<br />traffic tie-ups last year. They have had an architect working to design accoustical barriers,
<br />trying to block sound from going directly into the City. Mr. Groshong admitted there was noise,
<br />but he felt Eugene was a large enough city to have this type of activity, and that it was of
<br />benefit to the City.

<br />In answer to Mrs. Beal, the City Attorney said to close the operation it would be necessary for
<br />the city to bring a suit in court to have this declared a public nuisance. This is a process
<br />of weighing the benefits against the nuisance, as it applies to the entire community. It would
<br />be difficult to prove a nuisance, under the definition of this term. The action which could be
<br />taken would be to enforce the 10:00 p.m. closure on excessive noise. This applies in any zone,
<br />and can be enforced by the City.

<br />Mr. Mohr pointed out that the City could set times of operation or specific noise levels.

<br />Mrs. Beal asked if it would be possible to operate with loud speakers toned down and with mufflers
<br />on the cars. Mr. Groshong agreed the PA system could be turned down, but attempting to force
<br />use of mufflers would effectively close the operation. Reason for elimination of mufflers is
<br />to get more power, not to create noise. This would merely force cars to race on the streets.

<br />Mrs. Campbell pointed out that residents of 29th and Willamette have a real problem with noise
<br />at late hours. She felt the day was over when people could really have peace and quiet.

<br />Mr. Mohr indicated the Council's deep concern about the petitioners points. He said the Council
<br />is now aware of the problems at Balboa Drag Strip. The Police Department will be very careful
<br />to respond to complaints, and every member of the Council would be interested in hearing per-
<br />sonally if complaints persist.

<br />Mrs. Beal~as convinced the operators of Balboa tried to do their best, but she felt it would
<br />be difficult to control the, people who come there to race.
<br />
<br />Mr. McDonald moved seconded by Mrs. Campbell that the City Council recommend that Balboa
<br />be closed at 10:00 p.m. Mr. McDonald felt this would enforce the noise ordinance already In
<br />effect.

<br />In answer to the City Manager, Mr. McDonald said it was not his intent that ever.yone be gone
<br />from the area by 10:00 p.m.; but only that the noise ordinance be enforced;

<br />Mrs. Beal questioned whether a motion to this effect was necessary.
<br />
<br />There was further discussion about the intent of the motion. A vote was then taken on the
<br />motion. Messrs. Hershner, Mohr and Gribskov yoted no. Mrs. Campbell, Mr. McDonald and Mrs.
<br />Beal voted yes. The motion failed.

<br />IV. Bids, opened by Public Works Department, February 18, 1971
<br />Due to.the fact there was an irregularity in the bid bond, and this was an SCS Contract, the
<br />staff felt the contract should not be awarded, unless it was felt that award of the contract
<br />would be in the best interests of the City. After discussion, it was staff feeling that the
<br />reason for the bond is to insure that the contractor will fulfill his contract, and since
<br />D [, D Backhoe has indicated it would fulfill its part and has corrected the bonding error, the
<br />staff recommends the contract be awarded on the basic bid.
