<br />COUNCIL BILL NO. 9373 - Levying assessments for sanitary sewer between Gilham Road and Balfour
<br />Street and between Holly Avenue and Terresa Avenue was submitted and read in full the first time
<br />February 22, 1971, and held over to this meeting to allow proper notice of assessment to be given
<br />owners of affected properties, and is brought back for consideration with no written protests on file.
<br />
<br />Mr. Teague moved seconded by Mr.' Mohr that the bill be read the second time by council bill number
<br />only, with unanimous .90nsen~ of the Council, and that enactment be considered at this time. Motion
<br />carried unanimously and the bill was read. the second 'time by council bill number only.

<br />Mr. Teague moved second~d by Mr. Mohr that the bill be approved and given final passage. Rollcall
<br />vote. All councilmen present voting aye the bill was declared passed and numbered 16190.

<br />COUNCIL BILL NO. 9352'- Amending zoning ordinance to set criteria for controlled income
<br />and low rent housing was submitted and read the first' time on February 8, 1971 and was, at that
<br />meeting, tabled indefinitely.

<br />Councilman Williams had requested that this ordinance be removed from the table and given a second
<br />reading. He has been in conference with Planning Commission members and staff and has suggested
<br />a possible amendment to the ordinance which.would.allow densitv uu to 75fu of R-2 PD oensitv iu R-l
<br />zone only, and also would el1m1nate the m1n1mum slte area prop~seu for PuD. Mr. W1II1ams~s 111,
<br />but he called and indicated that he would have no objection to postponing action on taking the bill
<br />from the table, or if the Council wished to proceed, he would be agreeable to that.

<br />The Planning Director explained that Mr. Williams amendment would increase the density only in'the
<br />lower densith zones. It was the feeling of the Planning Department that the Council could adopt
<br />portions of the ordinance.without returning it. to the Planning Department.

<br />Mayor Anderson felt the ordinance should go back tothe,PlanningCommissio~ for review, since there
<br />did not appear to be an, eJTIergency.

<br />Planning Director said there was no emergency~;that he was,-aKar,e"of,_and.the legislatimwould not
<br />be needed for the next 15 or 20 days. ""-

<br />Mr. Teague moved seconded by Mr. Mohr to take Council Bill No. 9352 off the table and refer it back
<br />to the Plannigg Commission with suggestion for amendment.
<br />
<br />Mr, Mohr explained that the bill, as it E now written, would allow extremely high density in the
<br />R-4 area. The amendment would increase the size of units that could be considered under PUD, so
<br />that rather than bringing a project in under a particular zone, ,it could .be brought in under the
<br />PUD process and be more carefully controlled for density, access and other things.

<br />rezoning from RA to R-2 PD property located on the east side of Coburg Road between Willakenzie Road
<br />and Bailey Lane (Chowning Swartz) was ,submitted, and no councilman present requesting that it be
<br />read in full, was read the first time by council bill number only.
