<br />Mrs. Campbell explained that Mr. Lilja was not objecting to payment of the assessment,
<br />but was requesting deferral. City Manager explained that this would set a precedent,
<br />and that the City would be required to set up a fund to handle this sort of thing. The
<br />contractor has to be paid when the work is completed. There was Council discussion of its
<br />position in cases of this Mnd, and whether they shouild'work toward a state law change
<br />so that this type decision would be administrative and could simply be challenged in court.
<br />The City Attorney pointed out that the Council sits as a.quasi-judicial body, and that the
<br />City position is enhanced in court cases by Council decisions. If these decisions were
<br />administrative, there would be one hundred times as many court cases.

<br />City Manager reiterated that, if the .Council found itself ih a position where it attempted
<br />to adjudicate individual assessment complaints at its,meetings, the City would be required
<br />to adopt a new process to protect itself financially. File

<br />use of Robert's Rules of Order as a basis for its By-Laws. Mr. Hershner did not think a ';

<br />Mr. Barbarossa explained the inception o'f the program and the very real need for it. He
<br />pointed out limitations to those elderly or low income persons for government subsidized,
<br />housing, and how their group intended to encourage those in this segment to improve their
<br />lot through "self-help." Individuals will actually help with the construction of their
<br />own homes, thereby saving 30 to 45% of the actual cost of the home. It was possible to
<br />work in conjunction with the government; but people had to solve, their own problems. Mr.
<br />Barbarossa said they had received endorsement from many community agencies and organiza-
<br />tions, and that they hoped to provide housing, using the self-help 'concept.'

<br />Mr~~ Campbell thought the philosophy was excellent, but was unsure what the City's role
<br />would be.
<br />
<br />Mr, Barbarossa said they intended to be a non-profi t agency, and would have operating
<br />costs wnLcfLwould have to be met, Their budget was $60,000 per year for the next three
<br />years, They hoped the city could budget an aid to financing, In answer to Mrs. Campbell,
<br />he said they had contacted representati ves of labor and hoped they could overcome some of
<br />their objections.

<br />In answer to Mrs, Bea1, Mr. Barbarossa said they were requesting the city to fund 5 to
<br />10% of the operating budget.

<br />Councilman Mohr pointed out that it would be necessary to have an outline of requested
<br />in-kind contributions. He ci ted some examples of in-kind contributions th'e city might
<br />make. He said the city had committed itself to impr.ove housing, but wou+d need some
<br />explici t instructions and identification of levels of involvement. file

<br />S.B. 277, Allowing Controlled Backyard Burning - The City Manager said it was his
<br />understanding that, if this bill passed, it would supersede the City ordinance. He said
<br />Mr. Vern Adkison, Lane Air Pollution Authority, would attend the hearing and had requested
<br />Council direction regarding its position.
<br />
<br />Mr. AdKison said passage of this bill would set the City back 15 years in its progress
<br />toward abatement of air pollution.
<br />
<br />Mrs, Beal agreed to accompany Mr. Adkison to
<br />that the Council go on record, and that Mrs.
<br />Beal will compose such a letter.

<br />Councilman Mohr commented with regard to SB 277 that the City's voice was heard and an
<br />amendment has been placed on the bill which excludes the city of Eugene.

<br />that the Bank of America's annual report was printed on 100% recycled waste paper.
