Subdivision, Third Addition to Hollylawn Acres, approval of required walkway <br />without condition for fence or wall. <br /> <br />4/14/7-1 <br /> <br />This property is located on the south side of Jeppesen'Acres Road between <br />Coburg Road and Gilham Road. <br /> <br />I <br /> <br />The Planning Commission requested that the Council require that the dev- <br />eloper provide a five-foot sidewalk and five-foot bicycle-way to be <br />improved and developed to City standard width with a masonry wall, or <br />some other relatively indestructible fence, to be constructed on either <br />,side of the two walkways, and that both walkways be paved. Since the <br />Planning Commission has no legal authority to make this requirement, <br />it has requested ,the City Council to do so. The Council viewed the area <br />on tour. <br /> <br />Councilwoman Beal said the property owners knew the school was there when <br />they built, and they should be willing to pay for protection. <br /> <br />Mr. Hershner asked if the developer was willing to put up fences. <br />Planning Director said he was not very happy to pay for fences on both <br />sides. The City has no provision to assess abutting property owners. <br />It was hoped the City would accept some responsibility. <br /> <br />2~ty Attorney said there were legal problems and questions of benefit <br />to property owners. <br /> <br />Public Works Director said this would set a precedent, and there was some <br />question if the Ci ty would participate. This would put a burden on the <br />subdivider that has not been put on previously. <br /> <br />I <br /> <br />Mr. Mohr moved seconded by Mrs. Beal to approve the, subdivision with a <br />condition of requiring a paved walkway to the width indicated by the <br />Publi c Works Department', omi tting fence or wall. Release of Reserve Strip, east end of Souza Street <br />.It has been a practice to reserve a strip at the end of a dedicated <br />street to protect it so that it cannot be used as private property. <br />It is now requested that the reserve strip be dedicated so that the <br />street may go through. <br /> <br />J\.. <br /> <br />Mr. Mohr moved seconded by iMr. Teague to approve the recommendation <br />of the Planning Commission regarding release of a reserve strip at <br />the east end of Souza Street.
