All' councilmen present voting aye, the bill was declared passed and numbered 16199. e B. Planning Commission meeting of March 22, 1971 1. Subdivision, Third Addition to Hollylawn Acres, approval of required walkway without condition for fence or wall. 4/14/7-1 This property is located on the south side of Jeppesen'Acres Road between Coburg Road and Gilham Road. I The Planning Commission requested that the Council require that the dev- eloper provide a five-foot sidewalk and five-foot bicycle-way to be improved and developed to City standard width with a masonry wall, or some other relatively indestructible fence, to be constructed on either ,side of the two walkways, and that both walkways be paved. Since the Planning Commission has no legal authority to make this requirement, it has requested ,the City Council to do so. The Council viewed the area on tour. Councilwoman Beal said the property owners knew the school was there when they built, and they should be willing to pay for protection. Mr. Hershner asked if the developer was willing to put up fences. Planning Director said he was not very happy to pay for fences on both sides. The City has no provision to assess abutting property owners. It was hoped the City would accept some responsibility. 2~ty Attorney said there were legal problems and questions of benefit to property owners. Public Works Director said this would set a precedent, and there was some question if the Ci ty would participate. This would put a burden on the subdivider that has not been put on previously. I Mr. Mohr moved seconded by Mrs. Beal to approve the, subdivision with a condition of requiring a paved walkway to the width indicated by the Publi c Works Department', omi tting fence or wall. Release of Reserve Strip, east end of Souza Street .It has been a practice to reserve a strip at the end of a dedicated street to protect it so that it cannot be used as private property. It is now requested that the reserve strip be dedicated so that the street may go through. J\.. Mr. Mohr moved seconded by iMr. Teague to approve the recommendation of the Planning Commission regarding release of a reserve strip at the east end of Souza Street. Motion carried. Mr. Teague moved seconded by Mr. Mohr that Item 2 from the Planning Commission meeting of March 22 Be approved. Motion carried. ". 3. Annexations a. Third Addition to Churchill Highlands Subdivision, Referral to Boundary .,: . CorriiTIH3sion. Manager explained that this is a logical annexation and would allow development of both sides of 25th Avenue. I Mr. Mohr moved seconded by Mr. Williams to refer this matter to the Boundary Commission. Motion carried. b.
