<br /> Public Works Director commented that award is recommended on Items I and 2, and that
<br /> on No. 3, Sally Way, the recommendation is against award. ' This bid was over the estimate
<br /> approximately 15%. Property owners had been given an estimate of prices prior to
<br /> going to bid. That estimate was $8.00 per front foot, and the bid is higher, approx-
<br /> imately $9.77 per front foot.,
<br /> Regarding No. 4, Baxter Avenue, the staff has suggested that action be withheld for
<br /> federal government action for at least 90 days.
<br /> e Mr. Teague moved seconded by Mr. Mohr that low bids be awarded on Projects 1 and
<br /> 2, Project 3 be rejected and Project 4 withheld.
<br /> Regarding Project 1, Mr. Richard Freeman, 1140 West 6th, said he was the initiating
<br /> petitioner and that one of his neighbors had not been contacted and was not aware of
<br /> the proposal. He felt this should be delayed to give him an opportunity to appear
<br /> >1 if he wished.
<br /> In answer to Mr. McDonald, Mr. Freeman said he had the majority of the property (60% )
<br /> but that he did not feel he should go ahead with the project without giving his
<br /> neighbor a chance to appear.
<br /> Mr. Mcdonald commented that it was Council policy to pave alley's with over 50%
<br /> petition, and he felt the Council should go ahead.
<br /> Mr. Teague said he was willing to amend his motion to hold the bid for 30 days. This
<br /> was agreeable with Mr. Mohr his second.
<br /> Rollcall vote taken on motion as amended. Motion carried with all voting aye.
<br /> It was pointed out that there might have been others wishing to speak on other
<br /> projects.
<br /> Mr. Gene Fessenbecker, 2179 Marlow Lane, explained the situation on Marlow Lane,
<br /> and that there were only six people to be assessed for the project. He explained
<br /> that the ditch was four feet wide by six feet deep and had been're-routed from its
<br /> original location. He felt the project would benefit the entire area and that they
<br /> should not be assessed for the improvement. HIs main concern was that the ditch be
<br /> filled.
<br /> I City Manager pointed out that normal city policy had been added to, in this cas e ,
<br /> so that owners were paying only for % a 24" line. An al ternati ve might be for owners
<br /> to fence the ditch, or the city might contact owners to see if the higher estimate
<br /> was acceptable, and if the majority were willing, Council might reconsider its
<br /> r'

<br /> Director of Public Works said another property owner has asked to have his property
<br /> included in this project, which would mean the entire section from Gilham Road to
<br /> e Norwood would be covered.
<br /> Mr'~ Willard Alfson,
<br /> 2500 Forrester, said he owned one of the lots in question, and
<br /> he felt the ditch was dangerous to children in the area. He was concerned that the
<br /> di tch would still be uncovered in the vicinity of the school" and felt this should
<br /> also be covered. , ,

<br /> In answer to Mr. Alfson's suggestion that the city should close the entire ditch, the
<br /> City Manager pointed out that the city has many miles of open ditches, both in the
<br /> Willakenzie area and Bethel-Danebo. A storm sewer study has been made which indicated
<br /> that a complete storm sewer system in the Willakenzie area would cost around $7,000,000.
<br /> This would require a bond issue. The policy at present is for the subdivider to
<br /> pay up to 24" width, and the city pays the additional above the 24". In this proj ect,
<br /> which was initiated by the property owners,' the City Council agreed that the city would
<br /> pay half the cost of the 24" normally charged to the property owner. Therefore, the
<br /> city would be contributing more than its normal share of the project.
<br /> I Mr. Alfson suggested that a policy~shouldbe established whereby a subdivider would
<br /> deposit in escrow a sum of money to cover the cost of this kind of improvement.
<br /> Councilman Hershner suggested that the Council might take further action in this
<br /> matter. City Manag~r said the Council could reconsider and could ask staff to poll
<br /> the property owners.
<br /> e Ed Brockett, 1780 Norwood, said the building inspector had informed him that the
<br /> ditch on his property must be completed before he can take occupancy of his home.
