Mr. Rutan called for <br /> the question but Mayor Obie ruled that Mr. Arnold had begun to answer Ms. <br /> Wooten's question before Mr. Rutan's call. <br /> Mr. Arnold reviewed the easements that would be retained if the amendment to <br /> the motion is not approved. He said the retention of the pedestrian and <br /> emergency vehicular accesses has nothing to do with the public.s right to <br /> cross the railroad tracks. The retention would permit people to walk on an <br /> easement 24 feet wide. <br /> Responding to a question from Mr. Miller about liability if a pedestrian <br /> easement is retained and someone is hurt at the railroad crossing, Mr. Arnold <br /> said a decision on the vacation request will have no impact on the City's <br /> liability, although the City may have a responsibility for installing some <br /> signs. <br />e The amendment carried 3:2 with Councilors Bascom, Rutan, and <br /> Miller voting aye and Councilors Schue and Wooten voting nay. <br /> Reconsidering the main motion, Mr. Rutan moved, seconded by <br /> Mr. Miller, that CB 2979 as amended be read the second time by <br /> council bill number only, with unanimous consent of the council, <br /> and that enactment be considered at this time. The motion <br /> carried unanimously, 5:0. <br /> Mr. Rutan moved, seconded by Mr. Miller, that the bill be <br /> approved and given final passage. Roll call vote; the motion <br /> carried 3:2 with Councilors Bascom, Rutan, and Miller voting <br /> aye and Councilors Wooten and Schue voting nay. The bi 11 was <br /> declared passed (and became Ordinance No. 19495). <br /> VI. AIRPORT REVENUE BOND RESOLUTION <br /> City Manager Micheal Gleason introduced the item. Finance Director Warren <br /> Wong gave the staff report. He said the approval of the proposed resolution <br /> authorizing issuance of airport revenue bonds will provide the sixty-day <br /> remonstrance period required by the Oregon Uniform Revenue Bond Act.
