<br /> Ms. Jones pointed out that Exhibit A of CB 2979 indicates that a public <br /> utility easement will be retained over all of the present right-of-way and <br />e that emergency vehicle and pedestrian easements will be reta i ned on the <br /> eastern 24 feet of the right-of-way. She recommended that the council clarify <br /> its position on the easements. <br /> Answering questions from Ms. Wooten and Mayor Obie, Ms. Jones said the third <br /> paragraph of Exhibit A of CB 2979 retains a pedestrian easement and an <br /> emergency vehicular easement on Henderson Avenue that could be used if the <br /> railroad crossing is reopened. She said the Lane County Board of <br /> Commissioners approved the vacation and retained an emergency vehicle <br /> easement. They did not retain a pedestrian easement. <br /> Mr. Rutan said the councilors assumed that approval of the vacation would <br /> eliminate pedestrian and emergency vehicular access via Henderson Avenue. <br /> The councilors discussed their assumptions. Mr. Mill er suggested the <br /> ordinance be reconsidered. Several councilors said they would have changed <br /> thei r votes if they had real i zed that Exhi bit Areta i ned pedestri an and <br /> emergency vehicular accesses. <br /> Mr. Rutan moved, seconded by Mr. Miller, to reconsider <br /> CB 2979. The motion carried unanimously, 5:0. <br /> Ms. Wooten said she would support the ordinance with the assurance that <br /> Farwest Steel officials would make the accesses available to people. <br /> Ms. Jones responded that the accesses would be available only if the railroad <br /> crossing is officially reopened and it is unlikely that the PUC will approve <br />e the reopening. <br /> Mr. Gleason reviewed the authorities of the City Council and the PUC and said <br /> the PUC probably will not approve the use of the Henderson Avenue railroad <br /> crossing for either pedestrians or vehicles. <br /> Mr. Rutan moved, seconded by Mr. Miller, to amend the motion <br /> to delete the third paragraph of Exhibit A of CB 2979. The <br /> paragraph is: <br /> ALSO RESERVING herein an easement 24 feet in width along the <br /> eastern part of the above described property for its entire <br /> length for use for emergency vehicles. . . and for <br /> pedestrian use by the general public. <br /> Mr. Rutan said retaining pedestrian or emergency vehicular accesses is not <br /> reasonable. He said approval of his motion would retain a public utility <br /> easement in the Henderson Avenue right-of-way. <br /> Answering a question from Ms. Bascom, Mr. Gleason said the third paragraph of <br /> Exhibit A would make it possible for fire fighting equipment to use Henderson <br /> Avenue on either side of the railroad tracks but the equipment could not cross <br /> the railroad tracks because the area between them was torn up after the <br /> crossing was closed by the PUC.
