2005 Legislative Session IGR Commitee Bill Approval May 23, 2005 Exempts law enforcement officials acting in course of official duty from motor vehicle accident SB 0633 2 Support reporting requirements. Declares emergency, effective on passage. 3/17 Authorizes construction of single family dwelling on lot or parcel on which land use restriction or reinterpretation prevents construction of dwelling that could have been constructed when owner acquired lot or parcel. Requires landowner to apply to governing body of city or county, or its designee, for approval to construct dwelling. Requires governing body of city or county, or its designee, to approve or deny application within 120 days of date application is submitted. Provides for judicial review of denial of application. Specifies regulations that apply to siting and SB 0651 2 Oppose construction of dwelling. 3/09 Directs Department of Environmental Quality to create program for testing for toxic substances SB 0652 2 Support in fish found in waters of state. 4/14 Directs Department of Environmental Quality to establish program for testing of waters and sediment in Willamette River and its tributaries. Directs Oregon Watershed Enhancement Board to prioritize funding of restoration and enhancement of habitat within Willamette River basin. Allows State Parks and Recreation Department to use lottery moneys to finance SB 0653 2 Support acquisition of land and easements in Willamette River Greenway. 4/14 Requires owner of private real property zoned for forest use or mixed farm and forest use to comply with provisions of Oregon Forest Practices Act as in effect on December 2, 2004. Bars claim for compensation under chapter 1, Oregon Laws 2005, based on land use regulation that is part of Oregon Forest Practices Act as in effect on December 2, 2004. Declares emergency, SB 0654 2 Support effective on passage. 3/17 Requires city or county to take final action on application for permit, limited land use decision SB 0657 2 Oppose or zone change within 90 days after application is deemed complete, with specified exceptions. 3/09 Prohibits storage or disposal of hazardous materials and radioactive materials at solid waste disposal sites established in exclusive farm use zones. Prohibits storage or disposal of solid waste, hazardous materials or radioactive materials at sites in exclusive farm use zones on which land application of reclaimed water, agricultural or industrial process water or biosolids is SB 0681 2 Oppose/Am allowed. 3/24 Prohibits annexation or incorporation of specified industrial lands without written consent of landowner. Declares that specified industrial lands annexed or incorporated with consent of landowner retain in perpetuity development rights that apply when land is annexed or SB 0699 2 Oppose incorporated.
