<br /> Mr. Lindberg moved, seconded by Ms.Wooten, that the bill be <br /> approved and given final passage. Roll call vote. All councilors <br /> present voting aye, the bill was declared passed (and became <br />e Ordinance No. 19178). <br /> Mr. Gleason stated that the item will be added to the agenda of the <br /> September 21, 1983, council meeting for consideration of the emergency <br /> clause amendment. <br /> C. Appeal of Planning Commission's Denial of Rezoning Request for Property <br /> Located on the North Side of West 11th Avenue, extending from Seneca <br /> Street East Past Tyinn Street from 1-2 Light-Medium Industrial District <br /> to C-2 Community Commercial District (R. A. Chambers and Associates) <br /> (Z 83-13) (memo, map attached; background information distributed) <br /> Mr. Gleason introduced the a~enda item. Ms. Jones, Planning, presented the <br /> staff report, stating that t is issue is an appeal of a Planning Commission <br /> decision. She said that the property is very close to the property just con- <br /> sidered by the council. Ms. Jones said the property of approximately five acres <br /> is vacant except for a gasoline service station on the northeast corner of 11th <br /> Avenue and Seneca Street. She said the property to the north of the subject <br /> property is zoned 1-3 Heavy Industrial and is vacant except for the area along <br /> Seneca Street which is developed by the Monsanto Chemical Company. She stated <br /> that the south side of West 11th Avenue is zoned 1-2 Light-Medium Industrial and <br /> contains a mixture of commercial and industrial uses. She said that the Planning <br /> Commission voted 2:2 on August 2, 1983, to approve the request, but a tie vote <br /> is considered a denial; therefore, the applicant appealed the decision. Ms. <br /> Jones said that some of the concerns expressed by the Planning Comnission are <br />e the loss of industrial lands to commercial uses in the West Eugene area and <br /> limiting the expanse of strip commercial property along West 11th Avenue to uses <br /> that are already developed. Ms. Jones said that Ms. Mulder was present to <br /> discuss any Planning Commission decisions. <br /> There were no statements of ex parte contacts or conflicts of interest. The <br /> staff notes and minutes were entered into the record. <br /> Public hearing was opened. <br /> Jim Saul, 44 Club Road, Eugene, said he was representing the owner of the <br /> property and R. A. Chambers, who has a long-term land lease on the property. He <br /> said that this is a difficult issue to bring to the council since it involves a <br /> split vote by the Planning Commission and, therefore, contains no actual decision. <br /> He said the best that can be done is to glean the basis of the vote from the <br /> record and then ask the council to make a judgment based on the issues involved. <br /> He said that in reviewing the draft of the minutes of the Planning Commission, <br /> he felt the recitation of the discussion to be limited. He said that, according <br /> to his personal notes on the discussion, there were four issues raised. Of the <br /> first, he said the commissioners were split on whether the request conformed <br /> with the Metropolitan Plan; he therefore asked the council to consider the <br /> following: a) the four vacant parcels of land involved in the request were <br /> included in the allocation of property designated in the Metropolitan Plan for <br /> commercial use; b) the rezoning would be consistent with the planned text and <br /> policies; and c) in a series of prior actions, the City has consistently recog- <br />e nized the appropriateness of commercial zoning on the north side of 11th <br /> Avenue and east of Seneca Street. <br /> MINUTES--Eugene City Council September 12, 1983 Page 9 <br />
