<br />e Jim Saul, 44 Club Road, Eugene, said he is representing the owners of the <br /> property. He stated that since the council had the recommendation of the <br /> Planning Commission and the written materials he would simply respond to any <br /> questions from the members of the council. He said that the property owners had <br /> hoped for an emergency clause on the rezoning because one of the leasors of the <br /> property on the corner of 11th Avenue and Conger Street had ~ready entered into <br /> certain binding arrangements for the redevelopment of that property. He sa i d <br /> that this person has been waiting since the application was filed in June in <br /> order to proceed with the redevelopment and the delay has created some personal <br /> hardship. He said that without the six councilors necessary, the council could <br /> not take action on the emergency clause, but he did encourage the council to <br /> approve the rezoning as submitted and recommended by the Planning Commission. <br /> There being no further testimony, the public hearing was closed. <br /> Mr. Lindberg asked if it would be procedurally better to delay one week and then <br /> have a vote which would include the emergency clause. Mr. Saul responded tha t <br /> it would be helpful, but since it cannot be predicted if six councilors will be <br /> present, he felt that it would be better to have the council vote on the item at <br /> thi s time. <br /> Mr. Gleason suggested that the council approve the item at this meeting and then <br /> the council could vote on the emergency clause at the next meeting. He st res sed <br /> that the councilors present would also have to be present at the next meeting <br /> along with one councilor who had studied the material and had listened to <br /> the tapes of the discussion so that the council would be ready to vote on the <br />e emergency clause. <br /> Mr. Hansen asked if Mr. Saul would be willing to wait another week. Ms. Smi th <br /> restated the suggestion that the council could vote on the rezoning tonight <br /> and then consider the emergency clause at the meeting on September 21, 1983. <br /> Mr. Hansen again stressed his concern on having all five of the councilors <br /> present at the next meeting. Mr. Gleason clarified that six councilors who are <br /> well-advised on the rezoning application must be in attendance to vote on the <br /> request. <br /> CB 2680--An ordinance authorizing rezoning from 1-2 Light-Medium <br /> Industrial District to C-2 Community Commercial District <br /> for property located on the north side of West 11th <br /> Avenue, extending from McKinley Street west past Conger <br /> Street. <br /> Mr. Lindberg moved, seconded by Ms. Wooten, that findings sup- <br /> porting the rezoning as set forth in Planning Commission staff <br /> notes and minutes of August 2, 1983, be adopted by reference <br /> thereto; that the bill be read the second time by council bill <br /> number only, with unanimous consent of the council; and that <br /> enactment be considered at this time.
