Eugene Ordinance Exhibit B <br />[Lane County Ordinance Exhibit B] <br />scheduled for final adoption of the amendment, specified by the City in the initial notice of the <br />amendment. The Notice to DLCD was sent in October, 2012. That notice specifically stated that the City <br />initially scheduled final adoption for 2012. DLCD staff confirmed, at that time, that the notice had <br />"locked in" 2012 as the commencement date. <br />(3) A local government may review and amend the UGB in consideration of one category of land <br />need (for example, housing need) without a simultaneous review and amendment in consideration <br />of other categories of land need (for example, employment need). <br />Consistent with this rule, the actions taken by this ordinance are the outcome of the City's review of its <br />UGB in consideration of, only housing. Through a separate, concurrent action, the City and County are <br />taking actions in consideration of the need for employment, parks and school land. <br />(4) The determination of 20 -year residential land needs for an urban area must be consistent with <br />the appropriate 20 -year coordinated population forecast for the urban area determined under <br />Rules in OAR 660, div 32, and with the requirements for determining housing needs in Goals 10 and <br />14, OAR chapter 660, division 7 or 8, and applicable provisions of ORS 197.295 to 197.314 and <br />197.475 to 197.490. <br />See findings, above, under: OAR 660-024-0040(1); Statewide Planning Goal 10; Statewide Planning <br />Goal14; OAR 660-008; and OAR 197.295 to 197.314. <br />(8) The following safe harbors may be applied by a local government to determine housing need <br />under this division: <br />(b) If a local government does not regulate government -assisted housing differently than other <br />housing types, it is not required to estimate the need for government -assisted housing as a <br />separate housing type. <br />The HNA located at Part II of the Envision Eugene Residential Land Supply Study relies upon this safe <br />harbor. See findings under ORS 197.296(3)(b), above. <br />(c) If a local government allows manufactured homes on individual lots as a permitted use in all <br />residential zones that allow 10 or fewer dwelling units per net buildable acre, it is not <br />necessary to provide an estimate of the need for manufactured dwellings on individual lots. <br />The HNA located at Part II of the Envision Eugene Residential Land Supply Study relies upon this safe <br />harbor. See findings under ORS 197.296(3)(b), above. <br />(d) If a local government allows manufactured dwelling parks required by ORS 197.475 to 197.490 <br />in all areas planned and zoned for a residential density of six to 12 units per acre, a separate <br />estimate of the need for manufactured dwelling parks is not required. <br />The HNA located at Part II of the Envision Eugene Residential Land Supply Study relies upon this safe <br />harbor.
