If the exemption request is denied, the facility may be allowed to amend and <br />resubmit a reporting exemption request within sixty (60) days after denial, without <br />incurring an addition $150.00 tiling fee. <br />G. An exemption shall not be granted unless the facility follows the procedures outlined <br />above, and demonstrates evidence that its operations and use of hazardous substance(s) <br />pose little or no risk to public health or the environment. <br />H. Five out of the seven Toxics Board members must vote in favor of exempting the facility <br />in order for the facility to be exempted from all or part of the reporting requirements. <br />1. The Toxics Board shall render a decision on the facility's requested exemption within <br />twenty (20) days of the meeting at which the request was considered. The decision of the <br />Toxics Board is final. <br />After a facility has been approved for a three- (3) year exemption, and if there have not <br />been any changes in operations that effect hazardous substance use, an entity may submit <br />the Reporting Exemption Request Form, plus appropriate documentation to verify the <br />entity still poses little or no risk to public health or the environment in lieu of the report <br />prepared by an independent, certified professional for a subsequent three- (3) year <br />exemption from reporting. Following are examples of documentation the Toxics Board <br />will consider: <br />• Storm water report. <br />• Air emissions report. <br />• Fire Marshal's report. <br />Toxics Release Inventory report (SARA 312 Form). <br />• Inventory records. <br />• Production records. <br />• Shipping records. <br />K. Failure by a facility to accurately report changes in operations that effect hazardous <br />substance use while exempted from reporting is considered a violation of Section 54 of <br />the Eugene City Charter, and the facility will be subject to civil penalties. <br />
