<br />e <br /> <br />Responding to a question from Ms. Ehrman, City Attorney Bill Gary said that <br />recognition of the ICCO as a neighborhood association is not necessary to <br />make this ordinance legal, rather it is a policy question whether the City <br />wishes to enter into this type of an agreement with an association that has <br />not been officially recognized under the City's recognition policy. <br /> <br />The motion to table the ordinance failed 2:5; with councilors <br />Boles and Nicholson voting in favor, and councilors Rutan, <br />Bascom, Ehrman, Robinette, and Green voting against. <br /> <br />Mr. Boles said that he appreciates the hard work and effort of all parties <br />involved in this agreement, but still has some concerns about the content and <br />process by which this agreement was crafted. In particular, he voiced con- <br />cern with the lack of opportunity the council has had to review and modify <br />the ordinance and said that until he can be sure that this is a fair and <br />equitable agreement, he cannot support the motion. <br /> <br />Mr. Nicholson concurred with Mr. Boles and added that the community percep- <br />tion about the equity of this agreement is very important. He is reluctantly <br />voting against this agreement. <br /> <br />Ms. Ehrman said that she supports the annexation agreement, particularly <br />because it is equitable with respect to annexation agreements in other parts <br />of the City. Mayor Miller concurred, noting that a resolution of this issue <br />is in the public's interest. <br /> <br />e <br /> <br />Responding to question from Mr. Robinette, Mr. Gary said that the City Attor- <br />ney's Office has reviewed these documents. It is his opinion that staff has <br />represented them accurately. <br /> <br />Mr. Green said he will support the motion, but shares concerns regarding the <br />timing of the agreement. The mediation process that was used to create this <br />agreement should not be used again in the future. <br /> <br />Roll call vote; the motion carried 5:2; with councilors Rutan, <br />Bascom, Green, Robinette, and Ehrman voting in favor, and <br />councilors Boles and Nicholson voting opposed. <br /> <br />(At 9:15 p.m. the council took a five minute break.) <br /> <br />Councilor Ehrman left the meeting at 9:15 p.m. <br /> <br />V.
