All Council members present voting aye, the <br />bill was declared passed and numbered 17321. <br /> <br />Council Bill No. 772 - Levying assessments for sanitary sewer on Central Boulevard <br />from 28th Avenue to south 1200 feet, and between Central <br />Boulevard and Spring Boulevard to serve all lots in Hunter's Haven Subdivision <br />(74-38) - read the first time on March 24 and referred to April 7 hear1ng panel, <br />and held over from the April 14 Council meeting for consideration at this meeting <br />was read the second time by council bill number and title only, there being no <br />Council members present requesting that it be read in full. <br /> <br />Assistant Manager reviewed testimony received at the panel hearing indicating objections <br />of George Mayer, owner of property on Spring Boulevard, and said that since the prop- <br />erty had never been assessed, staff felt it should be included in accordance with <br />prior agreement. Don Allen, public works director, said that action to levy assess- <br />ment against Mr. Mayer'S property as proposed would be proper. With regard to the <br />Dutell property, he repeated staff's position stated at the panel hearing - that a <br />portion of the property had not been previously assessed for sewer service because it <br />had been added to the corner property since assessment for the 28th Avenue sewer. <br />The mere fact that the property had been pslit, he said, should not relieve the owner <br />of the assessment. Staff recommended levy of assessments in accordance with present <br />policy as proposed. <br /> <br />Mr. Murray moved second 'by Mr. Keller that the bill be approved and <br />given final passage. <br /> <br />Councilman Bradley restated his position that this corresponded to the assessment <br />against the Georgia-Pacific property, ,the sewer line was of no benefit to the property <br />being assessed and for that reason should not be assessed. <br /> <br />Rollcall vote was taken on final approval and passage. All Council <br />members present voting aye, except Councilman Bradley voting no, <br />the bill was declared passed and numbered 17322. <br /> <br />Council Bill No. 773 - Levying assessments for sanitary sewer on 1st Avenue <br />from approximately 1400 feet west of Seneca Road to <br />1200 feet east (74-49) - read the first time on March 24 and referred to April 7 <br />hearing panel, and held over from the April 14 Council meeting for consideration. <br />at this meeting - was read the second time by council bill number and title only, <br />there being no Council member present requesting that it be read in full. <br /> <br />4/28/75 - 13 <br /> <br />.
