He re- <br />iterated his opinion that if any horses at all were going to be allowed on the <br />property"he could see no difference in keeping two or six. <br /> <br />.e <br /> <br />Public hearing was closed, there being no further testimony. <br /> <br />Councilman Bradley expressed the opinion that the Zoning Board did have authority under <br />the city ::'ode to pass judgment on this request Eor variance, since horses were allowed <br />in the RA zone and the request was f6r reduction in'lot size. He felt there had not <br />been enough pl.oof of practical difficulties or unnecessary physical hardships and <br />that the appeal should be den1ec1~ . Councilman Murray concurred. He wondered if a <br />time .limit should be imposed for reduction ~n the number of horses not" kept on the <br />property. Gene Haxton, building department, noted Mr. Cornelison's appeal of the <br />violation to circuit court and said that staff probably would not take any action <br />until a decision in that case fI'as reached, so a time limitation would perhaps be in- <br />appropriate. He thought there would be court action in a reasonable length of time. <br /> <br />Recommendation: Unanimous, that the Zoning Board decision be upheld and <br />that the appeal be denied; that findings supporting denial <br />of the request as noted in building department staff notes <br />and Zoning Board minutes of March 27,. 1975 be adopted, as <br />well as findings of this Hearing Panel that sufficient <br />proof of practical difficulties and unnecessary physical <br />hardship had not been shown; and that the number of horses <br />now on the property be reduced to two within a reasonable <br />length of time, subject to building department inspections. <br /> <br />Approve <br /> <br />- <br /> <br />~ -" <br /> <br />5/12/75 - 18 <br /> <br />2.~3 <br />
