<br />e <br /> <br />Room Tax Allocation Guidelines - Proposed rewording has been distributed to <br />Council. Finance Director noted a couple of changes from the original proposed <br />guidelines. Paragraph 1 stipulates that the Room Tax Committee shall provide <br />reasons for their recommendations when presenting them to the City Council. Also, <br />Guideline No. 19 was added to provide for appeal to the City Council by an <br />applicant whose request is denied. Such an appeal must contain reasons for <br />objecting to the Committee's decision and it must be submitted to the Council <br />at the time the COmnUttee recommendations are submitted, which are on the first <br />of the month following the COmnUttee meetings. That allows the applicant ample <br />time to prepare an appeal if his request has been denied. since reasons for <br />denying must be stipulated, it gives the applicant tools to decide whether an <br />appeal is worthwhile. Lack of funds, for instance, would not be logically <br />appealable. <br /> <br />Mr. Keller moved seconded by Mr. Haws to approve the guidelines as <br />revised. The memo exp1a~ned <br />attempts to purchase-the property--had been uniiiiiccessfuT.-'- It --was understood <br />when the resolution was adopted that the matter would be brought back to <br />Council after every attempt had been made to acquire the property without <br />condemnation. Zoning Ordinance Re: Christmas Tree Lots - Memo has been distributed to Council <br />members. Staff has found that there are indeed violations occurring. There is <br />no authorization for such sales in areas residentially zoned. <br /> <br />No action was taken. <br /> <br />e <br /> <br />Mick NOlte, Building Inspection Superintendent, suggested an administrative <br />procedure which would require a slight amendment to the zoning ordinance _ to <br />write temporary permits for Christmas tree sales lots and include fireworks stands <br />as well to have additional control. <br /> <br />Mr. Murray was not sure if the recommendation would apply to residential as well <br />as commercial~ and he wondered if the permits could be restricted to commercial <br />zones. Mr. Saul suggested referring the matter to the Planning COmmission since <br />it would involve an amendment to the zoning ordinance. <br />Comm <br />Mr. Keller moved seconded by Mr. Hamel to refer the proposed amendment to 3/24/76 <br />the Planning COmnUssion for recommendation. Approve <br /> <br />The temporary permit system Mr. Nolte refers to, said Mr. Saul, is a simple code <br />amendment providing for a permit system in commercial zones. He had not <br />anticipated a permit system for residential zones. <br /> <br />Mr. Murray wondered about notifying those with residentially zoned lots before <br />the Christmas season. <br /> <br />Mr. Keller thought there might be instances in which having a Christmas tree lot in a <br />residential zone would be favorable. <br /> <br />e <br /> <br />Mr. Bradley concurred with Mr. Keller, feeling that the Planning Commission should <br />consider temporary permits in any zone. <br /> <br />t'l If <br /> <br />4/12/76 - 21 <br />
