Rezoning area at southeast corner of 29th and Willamette, from RG to C-2 SR <br /> (A&W Root Beer)(Z 76-20) <br /> The following council bill, read the first time on September 13, 1976 and <br /> held lacking unanimous consent for second reading at that time, is brought <br /> back for second reading and adoption of findings. <br /> C.B. 1234 - Rezoning to C-2 SR area at southeast corner of 29th <br /> Avenue and Willamette Street was read by council bill <br /> number and title only, there being no Council member <br /> present requesting it be read in full. <br /> Mr. Haws moved, seconded by Mr. Hamel, that findings supporting the rezoning <br /> as set out in Planning Commission staff notes and minutes of July 26, 1976, <br /> be adopted by reference thereto, and that the bill be approved and given <br /> final passage. <br /> Mrs. Beal said a lady had called her saying the matter had not received <br /> enough attention and she wishes to speak. City Attorney noted that if <br /> Council wishes to reopen the matter, it will have to reopne the entire <br /> matter. <br /> Mrs. Beal moved, seconded by Mr. Bradley that the hearing be reopened. <br /> Mrs. Beal felt the matter has rather serious implications on the whole 1990 e <br /> Plan. Also, she does not believe the people concerned about additional <br /> traffic have had an opportunity to voice their feelings. <br /> City Attorney noted that, if reopened, it would necessitate informing <br /> the applicant. Also, he said this is the first time he recalled Council <br /> asking to reopen a quasi-judical hearing. It must therefore be shown <br /> that there was some testimony not available at the time of the first <br /> hearing. <br /> With consent of the second, Mrs. Beal withdrew the motion. <br /> Vote was taken on the motion which failed, with Murray and Hamel <br /> voting aye; Haws, Bradley, Beal and Shirey voting nay, and Williams <br /> abstaining. <br /> e <br /> ~~~ Minutes 9/20/76 - 6 <br />
