All Council members <br />present voting aye, the bill was declared passed and numbered <br />17869. <br /> <br />. <br /> <br />R evi si ons of t!.!L Water Pol icy <br />Manager indicated the revision and new resolution were recommended <br />by the P1 anni n~ De pa rtment Fe brua ry 10, 1977. Mr. Ga ry Ch enk in, <br />Planning Department, stated the new revisions would replace the <br />policy adopted by the Council in March 1975. He said the proposed <br />revision by the Council was not so much a departure from present <br />policy adopted in March 1975 as it is more a detailed expression <br />of that pol icy. For example, with Boundary COHlmission approval, <br />the service would still be available to properties outside the <br />city but within the urban service boundary provided: 1) annexation <br />is appropriate or legally impossible; 2) water service will not <br />prolong the life of nonconforming uses; 3) the property is served <br />by an approved means of sewage disposal; and 4) the owner signs <br />an agreement to annex at the City's option. Mr. Chenkin said <br />that outside the urban service boundary, the proposed policy <br />would recognize existing service to Lane Community College and <br />the airport. Elsewhere, he said proof of a communicable disease <br />would be required. Current policy requires the existence of a <br />public health hazard, but does not necessarily require the presence <br />of a communicable disease. He stated that in areas once part of <br />the water district served by EWES, but subsequently dissolved, <br />special provisions would be included for forwarding requests <br />for water extension to the Boundary Commissison with information <br />regardi ng the Ci ty' s pol icy. He sai d exi sti ng statutes are not <br />clear as to the City' s responsibility in this type of situation. <br />Therefore, it would appear to be the best course of action to <br />allow the Boundary commission to consider service according to <br />its own standards, but with full knowledge of Eugene's policies. <br /> <br />- <br /> <br />Public hearing was opened. <br /> <br />A 1 etter from the League of Women Voters in support of the pro- <br />posed changes in the City's water policy was read by City Manager. <br /> <br />Public hearing was closed, with no further testimony being <br />presented. <br /> <br />Mr. Db i e andMr .
