<br />" <br /> <br />. <br /> <br />IV-B-3 <br /> <br />. <br /> <br />the request for a zone change, the Planning Commission was trying <br />to establish authority in setting its own guidelines and criteria. <br /> <br />Ma rston Morgan, 77712 Murray Creek Road, Cottage Grove, questi oned <br />what public interest was served in not recognizing this building <br />as historic and not accepted by the Historic Board. He urged the <br />Council to accept this appeal. <br /> <br />The public hearing was closed, there being no further testimony <br />presented. <br /> <br />Mr. Saul responded as to the legality of the issue, that the Historic <br />Review Board is simply a board of recommendation, and there is no <br />illeqality in not accepting its recommendation. He said in regard <br />to the zone chanqe criterion, that the sole justification to rec- <br />comend a zone chanqe is that if the house is historic and if it <br />merits recognition. He said that the Harlow House is a very nice <br />home, but that does not make it an historic home. <br /> <br />Mr. Obie asked if the Council would have to hold a meeting with <br />the Planning Commission if it were to disagree with the denial <br />of the appeal. Mr. Long, City Attorney' s office, said it was <br />required by Ci ty Code. Mr. Delay asked what time frame was in- <br />volved with this denial. Mr. Saul replied that if the denial <br />was upheld by the Council that the refiling date would be one <br />year from the date of its decision. <br /> <br />Mr. Haws moved, seconded by Mr. Hamel, to uphold the Planning Comn- <br />mission's denial of the application. Motion carried, with Council- <br />men Bradley and Qbie voting no, Council members Haws, Hamel, Delay, <br />Lieuallen, and Smith voting aye. <br /> <br />I. Liquor License Application <br />1243 West 7 th Street, Le Provencal e Re staurant- -new outl et (RMB) <br />R. J. Nicolai and G. S. Roddier; <br /> <br />Manager indicated that staff had no objections to this liquor <br />license. <br /> <br />Public hearing was opened. <br /> <br />Mr. Ralph Lake, 1055 Charnelton Street, said he was in attendance <br />to answer Council's questions. <br /> <br />Public hearing was closed, with no further testimony being <br />presented. <br /> <br />Mr. Haws moved, seconded by Mr. Hamel, to forward the liquor license <br />application with approval to the OLCC.
