<br />"- <br /> <br />Mr. Haws moved, seconded by Mr. Smith, to schedule <br />hearings for February 28, 1977. <br /> <br />Mr. Delay expressed concern regarding the annexation policy and, <br />asked if it could be a scheduled discussion item at a Committee-of- <br />the-Whole meeting in the future. Manager said that perhaps Mr. <br />Porter and Mr. Delay could get together and have a discussion first. <br />Mr. Haws and Mr. Bradley both expressed interest in attending such <br />a meeting. Mayor Keller said that he felt that it was the general <br />consensus of the Council that the item should be set for a Committee- <br />of-the-Whole discussion. <br /> <br />""--' <br /> <br />Vote was taken on the motion which carried unanimously. <br /> <br />V. Approval of request by LCOG Acting Executive Director for review <br />of proposal for limited compensation to Board Chairman (memo and <br />proposal distributed to Council) <br /> <br />Mr. Haws indicated that this request was made, with the issue being <br />whether the Chairman of the LCOG Board should be paid to offset his <br />lost income. Mayor Keller expressed concern over the legality of <br />doing something of this nature. Mr. Long, of the city attorney's <br />office, said he did not know and that he assumed that the Counsel <br />for LCOG had considered the problem. Mr. Obie asked whether compen- <br />sation could be made to the members of the Planning Commission. Mr. <br />Long replied it could not be made. Mr. Obie then said that because <br />the Planning Commission members, who spend hundreds of hours of time <br />are not reimbursed because of City policy, then he would not be in <br />favor of reimbursing on a piecemeal basis, in this instance for the <br />LCOG Board Chairman. Mr. Delay said that he did not like City policy <br />but the Council was dealing with another Board at this time and sees <br />no conflict. He said the merits of the case were that people are <br />losing income by serving and should be compensated for that loss. <br />Mr. Lieuallen raised the possibility that conceivably one Council <br />member could become LCOG Board Chairman and be receiving money and <br />that would be in conflict with the City Code. Mayor Keller said that <br />was a concern of his as to whether it was legal or not. He asked <br />staff to respond as to its legality. Mr. Bradley said the Council <br />could make a recommendation to support this request based on the <br />staff recommendations and findings. Mr. Lieuallen replied that <br />the charter is the City Council's policy and the City Council would <br />have to change the Charter to take another position. Mr. Long replied <br />that the Charter limits the Council on what it can do and this question <br />is different. LCOG is a separate governmental unit and has different <br />funding, etc. He said it was not an easy question to answer. <br /> <br />Mr. Lieuallen moved, seconded by Mr. Obie, to instruct <br />Mr. Haws to vote no on the proposed compensation request. <br /> <br />"- <br /> <br />2/28/77--c40 <br /> <br />\1b <br /> <br />Pub Hrg <br /> <br />. <br /> <br />e <br /> <br />. <br />
