He felt that <br />the Council should put it on the ballot at the next election after <br />the 90-day period had expired, taking the lowest cost approach <br />for the city. Mr. Williams noted that Mr. Delay could take the <br />position that all elections are equal, but he felt it was an <br />inadequate position. Mr. abie said that otherwise the city would <br />face the possibility of another election following this one with <br />people who are not satisfied with the results. He said the greater <br />number of people voting would increase the likelihood that the <br />city would not have to face another vote on this issue. Mr. <br />Delay reiterated that the people had done everything that was <br />required for them to get the issue on another ballot, and with <br />the possibility of litigation, he felt the city should not take <br />those kinds of chances. <br /> <br />Mr. Long said the Attorney's office would be most comfortable if <br />the City Council would select a date that is not past the next <br />general election. He again reiterated the uncertainty of taking <br />no action could lead to the city being governed by state statutes <br />which are very unclear, and could result in legal problems. <br /> <br />A vote was taken on the motion which failed, with Haws, Williams, <br />abie, and Smith voting aye; and Hamel, Delay, Bradley, and <br />Lieuallen voting no. <br /> <br />- <br /> <br />Mr. Long noted that in order to act within the 30-day time period, <br />Council should designate a date for the election to be held, but <br />not later than May, 1978, so that action could be taken April 11, <br />and in the event a unanimous vote was not received, final reading <br />could be held April 2S to stay within the 30-day time frame. <br /> <br />Mr. Hamel moved, seconded by Mr. Delay, that the election,on <br />the fluoridation issue be set for June 28, 1977. <br /> <br />Mr. Lieuallen moved, seconded by Mr. Delay, to amend the motion <br />to state that the fluoridation issue would be placed on the <br />first election after June 28, and no later than May, 1978. <br />Vote was taken on the amendment to the motion, which carried, <br />with Smith, Ramel, Bradley, Lieuallen, and Delay voting aye; <br />abie, Williams, and Raws voting no. <br /> <br />Vote was taken on the main motion which passed, with Smith. <br />Hamel.
