McGregor of Zoning Board of Appeals denial of <br />zon1ng variance. <br />Appeal distributed to Council. <br /> <br />Mr. Haws moved, seconded by <br />the appeals hearing for the <br />Panel Hearing, May 2, 1977. <br /> <br />Mr. Hamel, to schedule <br />hearing for the Assessment <br />Motion carried unanimously. <br /> <br />IV. Room Tax Ordinance <br />Ord1nance and resolution distributed to Council. <br /> <br />Manager noted that the ordinance and resolution followed the report <br />of the Room Tax Allocation Subcommittee's suggestions. He noted <br />that it was necessary to pass the ordinance and resolution in order <br />to handle the interim problems of allocating the room tax funds. <br /> <br />Stan Long, City Attorney's Office, reviewed the proposed ordinance. <br />He noted the ordinance earmarks or commits transient room tax <br />funds to the acquisition and maintenance of recreational, cultural, <br />convention, and tourist-related facilities and services; creates a <br />Subcommittee of the Budget Committee; provides for the composition <br />of a Subcommittee and sets forth the Subcommittee's powers; and <br />continues by ordinance the present Council Subcommittee until <br />July 1, 1977. In reviewing the resolution, Mr. Long noted that it <br />represented the Council's instructions to the Subcommittee in the <br />form of broad guidelines. He said the Subcommittee would formulate <br />specific expenditures within the guidelines as recommendations to <br />the Budget Committee. <br /> <br />Mr. Lieuallen expressed concern over the appointment by the Mayor of <br />the members of the Committee. He suggested that wording be inserted <br />to say "appointment by Mayor with approval by the Council". Mr. <br />Bradley felt that the appointments should be by Council members only, <br />as the Council members appoint the Budget Committee and he felt the <br />Subcommittee of the Budget Committee should thus be appointed <br />by the Council members. <br /> <br />Mr. Haws noted he supported the overall goals of both the ordinance <br />and the resolution. In particular, the sections he did not support <br />included: 1) The allocation of funds for certain functions which he <br />believes are wasting tax dollars; and 2) opposition to Mayor appoint- <br />ment. He felt it should be Council appointments to eliminate <br />catering to any special interest group in the community. <br /> <br />Mr. Delay concurred that he supported the general direction of the <br />proposal. The difficulties he felt included: 1) A need for a <br />broad base of appointment for the Subcommittee, as they would be <br />dealing with allocating room tax funds; 2) a concern regarding <br />the requirements for public members when there were no express <br />requirements for expertise in the arts; and 3) dissatisfaction with <br />technical details, saying he could not support the ordinance in its <br />present form. <br /> <br />Mr. Lieuallen said he was bothered by the appointment by the Mayor <br />and felt that he would not be prepared to make a decision on such an <br />important item by Monday, April 25, although he supported the general <br />thrust of the proposal. He noted another concern regarding makeup of <br />the Committee in terms of lay members, people who will be getting a <br />large portion of the money have no say at all in the makeup of the <br />Committee.
