: Mr. Obie had had calls from property owners on Orr Lane, saying the majority of the property owners did not want the improvement. He spoke against the motion and said he would vote against it. e Mr. Allen clarified for Mr. Obie that Council was initiating the process for authorization to set up a public hearing at which time the people affected would be allowed to present their arguments for or against. He said staff was requesting Council allow that procedure to be set in motion. Mr. Delay requested Staff Notes on the background of that policy by Public Works Department for the next request for improvement items. Mr. Haws said he would like staff to address the question as to what would happen if Council did not extend the sewers, whether that meant the property could not be developed. Vote was taken on the motions, with both carrying unanimously. IV. Public Works Contract Awards for 100 Percent Petition Improvements-- Opened August 2, 1977 (tabulation attached) A. Paving, sanitary sewer, and storm sewer within Oak Crest Subdivision and sanitary sewer within 160 feet of the north boundary of Oak Crest Subdivision B. Paving, sanitary sewer, and storm sewer within W. C. Fields Sub- division and sanitary sewer from south boundary of W. C. Fields Subdivision to the southeast 650 feet C. Paving, sanitary sewer, and storm sewer within 3rd Addition to Firland Heights; paving Spring Boulevard from south boundary of e 3rd Addition to Firland Heights to 250 feet south; and sanitary sewer to serve the area 160 feet south of the south boundary of 3rd Addition to Firland Heights D. Paving, sanitary sewer, and storm sewer within Humboldt Subdivision; paving within 160 feet south of Humboldt Subdivision E. Paving and sanitary sewer within Riggs Subdivision F. Sanitary sewer to serve Tax Lot 18-03-16-30-2100 adjacent to Skyline Drive G. Storm sewer within Annamidaz Subdivision H. Bicycle path 12th Avenue from Willamette Street to Oak Street 1. Paving overlays, various streets Don Allen distributed a corrected list of tablulation to Council. He noted two people wished to speak to two of the improvement assessments. The first assessment with a request for testimony was Item 5 (Job 1375) paving and sanitary sewer within Riggs Subdivision. Mr. A 11 en sa i d this had been petitioned by 84 percent of the property owners with the remainder being paid by the developer. He reviewed the cost to the abutting property owners and said Wildish Construction Company was low bidder. The project is to start within ten days of award of the contract.
