<br /> . <br /> . <br /> C.B. 1712 -- Authorizing rezoning from County RA and AGT to City R-1 <br /> property located east of Arcadia Street and north of Harlow - <br /> Road (Babcock) (A/Z 78-6) was read by council bill number <br /> and title only, there being no Councilor present requesting <br /> it be read in full. <br /> Mr. Bradley moved, seconded by Mr. Delay, that the bill be approved <br /> and given final passage. Roll call vote. All Councilors present <br /> voting aye, the bill was declared passed and numbered 18235. <br /> C.B. 1713 -- Concerning the fire code; amending Section 8.200 of Eugene <br /> Code, 1971, and declaring an emergency was read by council <br /> bill number and title only, there being no Councilor present <br /> requesting it be read in full. <br /> Mr. Bradley moved, seconded by Mr. Delay, that the bill be approved <br /> and given final passage. Roll call vote. All Councilors present <br /> voting aye, except Mr. Bradley voting no, the bill was declared <br /> passed and numbered 18236. <br /> V. ORDINANCES FOR FIRST READING--None <br /> VI. RESOLUTIONS <br /> Assistant Manager noted for Council the resolution concerning Best Lane had <br /> been the subject of concern between staff and property owners for some <br /> time. He noted it was necessary to acquire the right-of-way for street . <br /> improvements to provide access to the new subdivision of Fox Wood being <br /> developed by Breeden Brothers. The developer will reimburse the City for <br /> the cost of the right-of-way to the north. The east-side property owners <br /> will share their costs of the right-of-way. <br /> Resolution 2963 -- Authorizing use of eminent domain procedures <br /> re: acquisition of right-of-way on Best Lane <br /> for street widening was read by number and <br /> title. <br /> Mr Bradley moved, seconded by Mr. Delay, to adopt the resolution. <br /> Mr. Delay wondered about the circumstances under which this was occuring <br /> and whether the City was setting a precedent. Assistant Manager said <br /> the situation resulted in an inadequate right-of-way when the road was in <br /> the county. He noted any time there was increased traffic and a recommend- <br /> ation for street improvements, the City does proceed with those improvements. <br /> Rather than having the general taxpayers bear the cost of the acquisition, <br /> the conditions for granting the subdivision indicated the developer will pay <br /> the City for partial cost of the right-of-way. He said this circumstance <br /> could occur in the future, and noted this was a way to complete the job <br /> with minimum cost to the City. Mr. Delay expressed concern of the investment <br /> of staff time and cost. <br /> Vote was taken on the motion which carried unanimously. . <br /> 7/24/78--6 <br /> 52~ <br /> I <br />
