<br />II. Routine Items for Council Approval <br /> <br />e <br /> <br />A. Council Minutes April 18. 1979. <br /> <br />Ms. Smith moved, seconded Mr. Lieuallen, to approve Council <br />minutes as noted. Motion carried unanimously. <br /> <br />R. Legislative Subcommittee Minutes April 19, 1979. <br /> <br />Regarding S8 361, Mr. Haws suggested that at the last Legislative <br />Subcommittee meeting the members agreed to the concept of free speech <br />in shopping centers. A memorandum regarding the bill prepared by <br />Stan Long, City Attorney, was distributed. Mr. Long said the memo- <br />randum was for Council consideration of some concerns regarding the <br />bill. <br /> <br />Ms. Smith and Mr. Obie did not wish to amend the minutes, but wished <br />to discuss SB 361 at the next Legislative Subcommittee meeting. <br /> <br />Manager said that since the last discussion the issue had intensified. <br />There was a delegation from the Atrium very much concerned with the <br />trespass issue and enforcement regarding trespass. It is a very <br />important issue, he said. <br /> <br />- <br /> <br />Ms. Smith urged that the Council take no action today. Ms. Miller <br />said she could wait a week and would supply Councilors with a copy of <br />the new California Supreme Court case. In that case, it was ruled <br />that shopping centers are quasi-public places and are protected under <br />the California Freedom of Speech laws. <br /> <br />Mr. Obie asked that Pierce Brooks attend the Legislative Subcommitee <br />meeting, May 2, when the bill would be discussed at length. <br /> <br />C. Improvement Petitions. <br /> <br />Res. No. 3134--Authorizing initiating process for street paving, <br />sanitary sewer, and storm sewer construction to serve <br />Flatbush 2nd Addition; and street paving in Terry <br />Street from Roosevelt Avenue to 300 feet south; and <br />bridge construction over A-3 Channel at Terry Street <br />(1708) was read by number and title. <br /> <br />Ms. Smith moved, seconded by Mr. Lieuallen, to adopt the resolu- <br />tion. Motion carried unanimously. <br /> <br />Res. No. 3135--Authorizing initiating process for street paving, <br />sanitary sewer, and storm sewer within Bock's Addition <br />(1695) was read by number and title. <br /> <br />Ms. Smith moved, seconded by Mr. Lieuallen, to adopt the resolu- <br />tion.
