<br />- <br /> <br />Ms. Schue asked for more information. She wondered how much authority <br />the City had in this matter. Mr. Lieuallen asked the staff to research <br />the question of jurisdiction. He said the "quiet zone" had a great <br />appeal to him, and asked if that would be legally possible. <br /> <br />Mr. Long said that the question of jurisdiction was a tangle and would <br />take a long time to unravel. Did the Council want to pursue it? <br /> <br />Ms. Miller noted that this is an issue of the City, County (the <br />boat dock is on an easement owned by the County), the State Marine <br />Board, the State Department of Environmental Quality, and the Corp <br />of Engineers. It was hoped that action could be taken in a few weeks <br />as they get more information. <br /> <br />Manager noted that the intent of the motion was that, in perhaps a <br />month, staff would come back with preliminary answers, an estimate of <br />what might be involved, and the best way to pursue the matter. <br /> <br />Vote was taken on the motion which carried unanimously. <br /> <br />B. <br /> <br />Rezoning From RA to R-2 propertf Located West of Oak Patch Road On <br />North Side of West 15th Avenue Polioudakis) (Z 79-3) (Map Distri- <br />buted)--Unanimously recommended by the Planning Commission on April 3, <br />1979. <br /> <br />- <br /> <br />Mr. Saul said that this rezoning involves 9,780 square feet presently <br />developed as a single-family residence. The property could be devel- <br />oped to a maximum of three units under the proposed zone change. <br />Almost all the property surrounding this one is already zoned R-2. <br />Since 1967, there have been ten zone changes to R-2 along Oak Patch <br />Road between 18th and 11th. The findings of the Planning Commission <br />recommend this zone change on the grounds of consistency with the <br />General Plan, the issue of public need, and the other applicable <br />standards. <br /> <br />No ex parte contacts or conflicts of interest were declared by the <br />Councilors. <br /> <br />Staff notes and minutes were entered into the record. <br /> <br />Public hearing was held, with no testimony presented. <br /> <br />CB 1885--Authorizing rezoning from RA to R-2 property located west <br />of Oak Patch Road on the north side of West 15th Avenue <br />was read by council bill number and title only, there being <br />no Councilor present requesting it be read in full. <br /> <br />Mr. Delay moved, seconded by Mr. Hamel, that the findings sup- <br />porting the rezoning, as set forth in Planning Commission staff <br />notes and minutes of April 3, 1979, be adopted by reference <br /> <br />- <br /> <br />2~ <br /> <br />5/14/79--3 <br />
