<br />Planning Commission <br />October 10, 2006 <br />Page 2 <br /> <br />parking lots, to a commercial land use designation and a <br />commercial zone such as C-2 or C-3." (p. 14) <br /> <br />The staff report indicated that there is "strong policy basis for.a <br />commercial designation" and Mr. Yeiter confirmed that the Motor Pool <br />site parking lot and the Depot parking lot were properties <br />contemplated by this particular policy. <br /> <br />The applicant's position simply is that, when the Downtown Plan was <br />.adopted, this policy was adopted and Statewide Goal findings, <br />including findings on Goal 12, were made establishing the plan was <br />consistent with those Statewide Goals. The findings of the City <br />Council in adopting the Downtown Plan cited Transportation Planning <br />Rule OAR 660-0 12-0060(2)(a)-(d) and stated: <br /> <br />"The Downtown Plan and related code amendments will <br />not significantly affect a transportation facility since they <br />do none of the things described in (a)-(d), above. <br /> <br />Four streets are proposed to be characterized as 'Great <br />Streets': Broadway,.Willamette, Fifth Avenue and Eighth <br />Avenue. 'The plan proposes that design standards and <br />guidelines be drafted for each street to emphasize <br />pedestrian amenities, and to attract pedestrian friendly <br />development, in an effort to create a 'walkable' downtown. <br /> <br />No change in the functional classification of these streets <br />is intended to result from this Plan. In addition, no <br />changes are proposed to the standards that implement the <br />functional classification system. The Plan does not, by its <br />adoption, allow types or levels of land uses which would <br />result in inconsistencies with the functional classification <br />of a transportation facility, or reduce the performance <br />standards of the facility. <br /> <br />Therefore, the proposed refineme.nt plan adoption is <br />consistent with Statewide Planning Goal 12." <br /> <br />The September 19, 2006 dialog between the Commission and the staff <br />proceeded from the discussion of this particular site to concerns that <br />all the "Dozen Downtown Development Areas" set forth of page 45 of <br />the Eugene Downtown Plan might then be argued to be eligible for <br />redesignation to Commercial without any traffic impact analysis.
