<br />close of the public hearing record, the Planning Commission would make a recommendation, <br />based on the required approval criteria, to the City Council to approve, approve with <br />modifications or deny the applications. The requests would be heard before the City Council in a <br />separate public hearing, following a~tion by the Planning Commission. The quasi-judicial <br />hearing procedures applicable to this request were described at EC 9.7065 through EC 9.7095. <br /> <br />Application, Referrals and Public Hearing Notice <br /> <br />The property subject to this request was th~ State of Oregon Motor Pool site, located at the <br />southeast corner of Pearl Street and Fourth Avenue. It was approximately 1.71 acres in size. The <br />property was currently being used as surface parking for State motor pool vehicles. On April 2, <br />2006, the owner's representative submitted applications to the City of Eugene for amendments to <br />the Metro Plan as well as a concurrent rezoning application. Following the receipt of the City's <br />completeness review comments, the applicant provided supplemental materials on June 8, 2006. <br />On July 14, 2006, the City requested additional information related to potential transportation <br />impacts. On July 24 and August 21, 2006, the applicant submitted additional revised findings for <br />Goal 12, Transportation. On July 28, 2006, the application was deemed complete without the <br />additional requested information, at the applicant's request. <br /> <br />As detailed in the staff reported included with the agenda for the September 19, 2006 public <br />hearing, referrals were provided to the appropriate agencies, and notice of the public hearing was <br />mailed and posted consistent with Eugene Code requirements as described in the staff report. No <br />letters of public testimony were received between the date of public notice. (August 18, 2006) and <br />the date the staff report was prepared (September 12, 2006). Any written comments received <br />after the preparation of the staff report would be provided to the Planning Commission at the <br />public hearing for inclusion into the public record. <br /> <br />Applicable Criteria <br /> <br />The Eugene Planning Commission shall address the relevant approval criteria from sections <br />9.7730(3), 9.8424, and 9.8865 of the Eugene Code (EC) in making recommendations to the <br />Eugene City Council on the proposals, as listed below: <br /> <br />EC 9.7730(3) Criteria for Approval of Plan Amendment <br />The following criteria shall be applied by the City Council in approving or denying a Metro Plan <br />amendment application: <br />(a) The amendment must be consistent with the relevant Statewide Planning Goals <br />adopted by the Land Conservation and Development Commission; and <br />(b) Adoption of the amendment must not make the Metro Plan internally <br />inconsistent. <br /> <br />EC9.8865 Zone Change Approval Criteria. <br />Approval of a zone change application, including the designation of an overlay zone, shall not be <br />approved unless it meets all of the following criteria: <br />(1) The proposed change was consistent with applicable provisions of the Metro <br />Plan. The written text of the Metro Plan shall take precedence over the Metro Plan diagram <br />where apparent conflicts or inconsistencies exist. <br />(2) The proposed zone change was consistent with applicable adopted refinements <br />plans.
