ΘStrengthenthepedestrianconnectionbetweenthedowntowncoreandactivityon <br />5thAvenue,andultimatelytotheplannedRiverfrontParkandtheWillametteRiver. <br />AnalysisfromPublicWorksstaffconfirmsthesurroundingstreetnetworkisatraditional <br />blockedstreetgrid,whichprovidesamplestreetconnectivityasrequiredbyEugeneCodeand <br />negatestheneedforasecondarypublicthoroughfare.Becauseoftheexistinglocalstreetgrid, <br />thealleystobevacateddonotprovidesignificantpublictransportationbenefit,althoughthey <br />doprovidepublicvehicularandpedestriancirculationonadjoiningstreetsaswellasthe <br />primaryparkingfacilitiesforthesurroundingbusinesses(primarilythe5thStPublicMarket). <br />Theproposedvacationwillnotimpedeormodifyonsitecirculationatthistime.Tothenorthis <br />East5thAvenueandtothewestisOakStreet,bothlocalCitystreetsandfullyimprovedwith <br />paving,curbandgutter,bikelanes,sidewalksandstreetlights.PearlStreetistotheeastandis <br />uthisamajorarterial.Thesurroundingstreet <br />amajorcollectorn,andEast6thAvenuetotheso <br />networkprovidesampletransportationfacilitiesforallusersandisconsistentwithcitydesign <br />standardsandmasterplans.Theproposedalleyvacationwillnothaveasignificanteffecton <br />rightofwayvacation <br />thesurroundingtransportationsystems.PublicWorksstaffsupportsthe <br />fromtheperspectiveofprovidingadequatetransportationfacilitiesandservices. <br />Theapplicanthasnotprovidedplansshowingafeasiblerelocationoftheexistingfacilitiesin <br />therightofwaytobevacated.Theutilitiescurrentlyprovideservicetoexistingdevelopment <br />andimprovedpublicrightsofway.TheapplicanthasproposedaPublicUtilityEasement(PUE) <br />overtheentirevacatedareauntilsuchtimeasplanscanbeprovidedandapprovedthrougha <br />developmentorpublicimprovementpermitapplication.AsubsequentPUEvacationprocess <br />willberequiredpriortotheapprovalofdevelopmentorpublicimprovementpermits.The <br />proposedPUEprovidestheeasementnecessarytocontinueperpetualownership,operation <br />andmaintenanceofpublicutilitiesthatremain.PublicWorkssupportstherightofwayvacation <br />contingentuponthereservationofaPUE. <br />Conclusion: <br />TheğƦƦƌźĭğƓƷƭrequestedrightofwayvacationisinthepublicinterest,basedontheabove <br />factsandthetermsoftheordinance. <br />ExhibitC:Findings <br />*´«¸ ΐΕǾ ΑΏΐΗǾ 0´¡«¨¢ (¤ ±¨¦ £ -¤¤³¨¦ ȃ )³¤¬ Β <br /> <br />
