17  <br />  <br /> <br />CRB Members discussed whether or not the constitutional rights allegation was <br />appropriate. Ms. Pitcher explained that at the time of the investigation the allegation was <br />the officer had tried to coerce the father to speak, it wasn’t until the investigation was <br />started that the allegation was determined to not be true. Members also commented on the <br />excellent job done by the IA Sergeant interviewing and getting the facts of the situation. All <br />but one member agreed with the adjudication recommendations. <br />  <br />D. May Case Reviews – Service Complaints <br /> <br />[Comment: Service Complaints are reviewed by direct supervisors and approved by <br />command staff for thoroughness and appropriate classification. The OPA reviews <br />the Service Complaints. Annually, the CRB reviews a selection of Service <br />Complaints.] <br /> <br />Complaint 1: <br /> <br />• Officer A stopped a vehicle under suspicion of DUII. He learned the driver was <br />affected by a medical condition, and that the driver had recently met his passenger, <br />who had offered to help him get home. However, the vehicle was traveling in the <br />wrong direction to get to the driver’s home. <br />• Officer A began to suspect that the passenger may be taking advantage of the <br />driver and asked for his identification. RP complained at that point that he was <br />being harassed due to his race, and Officer A requested a supervisor respond. <br />• The supervisor explained the officer’s actions to the RP. <br />• Further investigation indicated that the officer’s instincts may have been correct, <br />as RP had a record of robbery. <br />• The supervisor recorded the complaint in BlueTeam and recommended that it be <br />closed. Our office concurred. <br /> <br />• Classification: Inquiry <br /> <br />Issues for the CRB: <br /> <br />Several CRB members felt that the passenger’s previous record was not relevant to his <br />complaint of harassment due to race. One member felt that the case was handled well and <br />appreciated the Blue Team function that allowed supervisors to document complaints. The <br />Auditor commented that a new law mandated a process for allegation of discrimination to <br />be reported to a supervisor and for EPD follow-up reporting to the State of Oregon Law <br />Enforcement Contacts Committee. <br /> <br />Complaint 2: <br /> <br />September 24, 2018, Work Session – Item 2
