Under OAR 660-012-0060(2), <br /> a plan or land use regulation amendment "significantly affects" a transportation facility if it (1) <br /> changes the acknowledged functional classification of an existing or planned transportation facility; <br /> (2) changes standards implementing the functional classification system; (3) allows types or levels of <br /> land uses which would result in levels of travel or access inconsistent with the functional <br /> classification of the facility; or (4) reduces the performance standards of the facility below the <br /> minimum acceptable level identified in the TSP. <br /> <br /> The change from the Approved Design to the Modified Project alignment has none of these effects. It <br /> does not change the acknowledged function of the West Eugene Parkway or alter the standards <br /> implementing the fimctional classification system. It does not alter the types or levels of permitted <br /> land uses in the area, and the levels of travel and access it would permit are consistent with its <br /> planned function as a major limited access highway serving primarily regional and through travel. <br /> Further, it would not reduce the' WEP's performance standards below the minimum levels set out in <br /> the acknowledged Lane County and City of Eugene Transportation Plans. Indeed, at every affected <br /> intersection, the Modified Project improves performance over the no-build alternative and achieves <br /> minimum acceptable level of service standard requirements.29 See Alternatives Memorandum, <br /> Appendix B. <br /> <br /> Although the WEP with the Modified Project alignment would not significantly affect a <br /> transportation facility, its absence would have that effect because, even with the substantial protection <br /> of lands in the area under the WEW?, other planned development in West Eugene still would increase <br /> tra~c on existing streets to levels that are inconsistent with their functional classifications. Without <br /> the West Eu ene Parkwa b the ear 2015 the level of service at eve ma'or intersection along <br /> West I Ith Avenue eastward to Ga~eld Street at 6th and 7th Avenues deteriorates to <br /> ater than 1 00 See Appendix B, Alternatives Memorandum. The <br /> Modified Project is needed to retain a balance between the transportation system and projected land <br /> uses and growth in population and employment through the planning period. <br /> <br /> Compliance with OAR 6604124065 <br />OAR 660-0 t 2~0065 identifies the types of transportation improvements "which ma3, be permitted on <br />rural lands consistent with Goals 3, 4, 11, and 14 without a goat exception." Because the list of <br />permitted transpor~tion improvements does not include new four-lane limited access highways on <br />rural lands, OAR 660-012-0065 does not apply. Instead, the exception standards in OAR 660-012- <br />0070 apply. See OAR 660-012-0070(t ). <br /> <br />Compliance with OAR 660-0 2.0070 <br />OAR 660-012-0070 contains the requirements and standards for taking goal exceptions to justify <br />transportation facilities and improvements on rural lands. These standards~ set out in OAR 660-012- <br />0070(1) through 660-012-0070(8), are addressed below. <br /> <br />OAR 660-012-0070(1) requires an exception for siting transportation facilities on rural lands that do <br />not meet the requirements of 660-012-0065.
