WEST El~NE PARKWAY ~EIED PROJECT-4'.,ONSIS~NCY WiTH THE STATEWIDE PLANNING GOALS AND TRANSPORTATION PLANNING RULE <br /> <br />OAR 660~012-0070(2) provides that where exceptions to Goals 3, 4, 11 or 14 are required, "the <br />exception shall be taken pursuant to ORS 197.732(1)(c), Goal 2, OAR 660, Division 4 and this <br />division." Because OAR 660, Divisions 4 and 12 implement Goal 2 and ORS 197.732(1)(c), a <br />demonstration of compliance with these administrative role requirements demonstrates compliance <br />with all of these review standardsfi0 <br /> <br />This technical memorandum provides the findings of fact and reasons demonstrating compliance with <br />the applicable exception standards, as required by Goal 2 and ORS I97.732. <br /> <br />OAR 660-012-0070(3) requires that "an exception adopted as part of a TSP or refinement plan shall, <br />at a minimum, decide need, mode, function and general location fbr the proposed facility or <br />improvement." <br /> <br />As noted above, the West Eugene Parkway project is already a~n element of the 7?ansPlan and the <br />Lane Counr)~ Rura! Comprehensive Plato31 The acknowledged 1986 exception identified the need fbr <br />the project32 and determined ks mode (highway), function (limited access major arterial) and general <br />location~ This current exception is required only to change the general location of the approved <br />facility from south oft he railroad tracks to north of those tracks. <br /> <br />Figure 1 show's the corridor within which the Modified Project would be locate& The Modified <br />Project would have four 12-foot wide travel lanes with 8-foot wide shoulders on the outside of the <br />lanes. A center median would var5, in width from 12 to 14 feet. See Roadway Profiles at Figure 2-3 of <br />the SD£JS. The alignment shift northward f?om the Approved Design would be accomplished wkh a <br />grade-separated crossing over the Central Oregon and Pacific railroad tracks and the Amazon <br />Channel near Terry Street. <br /> <br />The precise location of the facility within the corridor will be determined during project design. <br />Because the facility is a state highway, its design and construction will comply with established <br />ODOT standards for constructing urban, statewide limited access facilities, and with local standards <br />and procedures where applicable. <br /> <br />OAR 660-0 2.0070(4), ORS 197.732(1)(c)(A), Goal 2 Part OAR <br />0020(2)(a) and OAR <br />OAR 660-012-0070(4) states: <br /> <br /> "To address Goal 2, Part Il(c)(1) the exception shall demonstrate that there is a transportation <br /> need identified consistent with the requirements of 660-012-0030 which cannot reasonably be <br /> accommodated through one or a combination of the following measures not requiring an <br /> exception: <br /> <br />"(a) Alternative modes of transportation. <br /> <br />30 The language in ORS 197.732(~1)(c) ~s klentical to the Goal 2 exception language set out above in the analysis of <br />compliance with statewide planning goal 2. <br />31 Because the TransP~an was adopted pdor to LCDC adoption of the Transportation P~anning Rule, it is not a TSP as that <br />term is used in the ru~e. The Lane Counci~ of Governments is currently developing a regional TSP to comply with TPR <br />requim~nts. According to C~ of Eugene Planning Director Jan Childs, that plan currently is scheduled for hearings in the fall <br />of 1999, with adoption unlikely pder to June 2000. <br />32 ~e ~986 ex~ption k~entifles this project as needed to provide a safe transition to Highway 126 and to avo~ the existing <br />narrow, oa~ed ove~ass at the Southern Pacffic [now Centra~ Oregon and Pac~cl railroad tracks.
