adjacent to more than one street, a building is required to meet the maximum <br />setback standard only on Garden Way or Marche Chase Drive~ <br /> <br />Section.. 3_~ Section 9.8030 of the Eugene Code, 1971~ is amended by adding a new <br /> <br />Subsection (16) thereto, to provide: <br /> <br /> _Review - A~proval Criter.ia_, The planning director shall approve, <br />conditionally approve, or-~leny an a4iustment review application~ Approval or <br />conditional approval shall be based on compliance with the following applicable criteria. <br /> <br />S-CN Chase Node Special Area Zone Standards Adjustment. A standard <br />applicable within the S-CN Chase Node Special Area Zone Subarea C~ HD1L/MU <br />or HDR may be adjusted upon a finding that the proposed adjustment: <br />(a) ls consistent with the purposes of the S-CN Chase Node Special Area Zone <br /> as set forth at EC 9~3100; and <br />(b) Meets the applicable adjustment crkeria in another subsection of EC 9.8030, <br /> if any. <br />If there is no EC 9.8030 subsection that pertains to the type of standard being <br />considered, adjustment may be permitted based solely on compliance with EC <br />9.8030(16)(a). <br /> <br />Sect~0n 4, Section 9.8865 of the Eugene Code, 1971~ is amended by adding ~n numerical <br /> <br />order by code provision~ a new SUbparagraph to Subsection (4), and relettering the subparagraphs <br /> <br />that follow., to provide: <br /> <br />9,8865 <br /> <br /> ange Approval Criteria. Approval of a zone change application, including <br />the design'ati0n (~-an overl~ zor shall not be approved unless it meets all of the <br />following criteria: <br /> <br />(4) The proposed zone change is consistent with the siting requirements set out for <br /> the specific zone in: <br /> <br />(g) EC 9.3105 S-CN Chase Node Sp_~cial Area Zone Siting Re ; <br />(h) EC 9.3205 _S.S-DW Downtown Westside Special Area Zone Si.~ir!g <br /> gequirements. <br />(i) EC 9.3305 S-E Elmira Road S. pecial Area Zone_S.~ng nt_s~ <br />(j) EC 9.3705 S-RP Riverfront Park <br />(k) EC 9.3905 S-W Whiteaker Special Area Zone S . <br />(1) EC 9.4715/WP Waterside Protection Overlay Zone Siting Requirements. <br /> <br />Ordinance - 16 <br /> <br /> <br />
