ZONECHANGES <br /> <br />The Eugene City Council will apply the following criteria frorn EC 9.8856 to proposals to rezone <br />properties: <br /> <br />The proposed change is consistent with applicable provisions of the Metro Plan. The <br />written text of the Metro Plan shall take precedence over the Metro Plan diagram <br />where apparent conflicts or inconsistencies exist. <br /> <br />The proposed Chase Gardens Node Special Area zone would implement the Metro Plan's nodal <br />development policies, as discussed above. F011oMng the addition of the ND--Nodal <br />Development Metro Plan diagram designation to the property through a separate action by the <br />City Council and the Board of County Commissioners, the proposed zone changes are consistent <br />with the Metro Plan diagram as well. <br /> <br />(2) <br /> <br />The proposed zone change is consistent with applicable adopted refinement plans. In <br />the event of inconsistencies between these plans and the Metro Plan, the Metro Plan <br />controls. <br /> <br />The proposed Special Area Zone for Chase Gardens, as analyzed in the report "Chase Gardens <br />Nodal Development Area," by Satre Associates, July 29, 2001, implements the nodal <br />development principles as planned in the Willakenzie Area Plan. The proposed zone allows <br />preservation of the five-property Chase Gardens historic ensemble. <br /> <br />(3) <br /> <br />The uses and density that will be allowed by the proposed zoning in the location of <br />the proposed change can be served through the orderly extension of key urban <br />thcilities and services. <br /> <br />Key urban services that are already in place for at least all the incorporated properties and <br />portions study area include water, electricity, telephones, sanitary sewer, storm drainage, natural <br />gas, recreation, library, police, fire, EMS, streets, and administration. Those ser;4ces not yet <br />available to 'unincorporated properties (e.g., sanitary sewer and natural gas) will be extended to <br />those properties with the improvements to Garden Way. These street improvements are scheduled <br />to conm~ence in Year 2002. <br /> <br />(4) <br /> <br />The proposed zone change is consistent with the applicable siting requirements set <br />out for the specific zone in: <br /> <br />(a) EC 9.2150 Commercial Zone Siting Requirements. <br /> <br />Exhibit A - 20 <br /> <br /> <br />
