(5) Development Standards. <br /> <br />(b) <br /> <br />Setbacks. For any new building, residential flag lots shall have a <br />minimum 10 foot building setback along all lot lines. The special flag lot <br />setback standard does not apply to flag lots that received final plat <br />approval by [insert effective date of amendmentl. <br /> <br /> Section 4. The Legislative Findings set forth in the attached Exhibit A serve as support <br />for this Ordinance, but are not adopted. <br /> <br /> Section 5. The City Recorder, at the request of, or with the concttrrence of the City <br />Attorney, is authorized to administratively correct any reference errors contained herein or in <br />other provisions of the Eugene Code, 197t, to the provisions added, amended or repealed herein. <br /> <br /> Section 6. If any section, subsection, sentence, clause, phrase or portion of'this <br />Ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, <br />such portion shall be deemed a separate, distinct and independent provision and such holding <br />shall not affect the validity of the remaining portions hereof. <br /> <br /> Section 7. Notwihhstanding the effective date of ordinances as provided in the Eugene <br />Charter of 1976, this Ordinance shall become effective 30 days from the date of its passage by <br />the City Council and approval by the Mayor, or upon the date of its acknowledgment as provided <br /> <br />by ORS 197.625, Whichever is later. <br />Passed by the City Council this <br /> <br />25® day' of November, 2002 <br /> <br />city <br /> <br />Approved by the Mayor this <br /> <br />25th day of November~ 2002 <br /> <br />Ordinance - 3 <br /> <br /> <br />
