ORDINANCE NO, 20277 <br /> <br />AN ORD][NANCE CONCERNING TELECOMMUNICATIONS <br />AND AMENDING SECTION 3.415 OF THE EUGENE CODE, <br />1971, AND PROVIDING AN IMMEDIATE EFFECTIVE DATE~ <br /> <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br /> <br />Section 1. SrfDsections (1) and (8)(a) of Section 3.415 of the Eugene Code, 1971, are <br /> <br />amended and a new subsection (9) is added to Section 3.415 of the Eugene Code, 1971, as follows: <br /> <br />3:415 Telecommunications - Annual Registration and License Fees. <br /> (1) Aunual Registration Fee. Each person required to register under section 3.405 <br />of this code, except an operator of a private communications system, shall pay to the city an ammal <br />registration fee ~n the amount of 2% of the registrant's gross revenues derived from its <br />~elecommunicafion acfivkies wkhin the city. In addition, the first anrmal registration fee paid by a <br />reg}strant shalt include ~ addkional charge, in an amount set by the city' manager pursuant to section <br />2.020 of this code, that is calculated to recover all of the city's costs incurred in processing the <br />registration, as well as a share of the city's costs in preparation of the city's telecommunications <br />plan, this ordinance, and the implementing rules. <br /> (8) Penalties and Interest. <br /> (a) Any registrant or licensee who has not been granted an extension of <br /> time for remittance of a f~e due and who fails to remit any fee imposed reader this <br /> section prior to delinquency shall pay a penalty of ten percent (10%) of the amount <br /> of the fee due in addkion m the amount of the fee. <br /> (9) Calculation of Fees. In determining gross revenues for the calculation of fees <br />under this section, the city shall consider mobile telecommunications services to occm- within the <br />cky if they are used by a customer whose place of primary use is wkhin the city. As used in this <br />section, ~;place of primary use" means the residential street address or the primary business street <br />address of the customer. The city shall apply this provision consistently with the Mobile <br />Telecommunications Sourcing Act, 4 USC 116 to 126. <br /> <br /> Section 2. The City Recorder, atthe request of, or with the concurrence of the City Aaorney, <br />is authorized to administratively correct any reference errors contained herein or in other provisions <br />of the Eugene Code, 1971, to the provisions added, amended or repealed herein. <br /> <br />Ordinance- 1 <br /> <br /> <br />
